Stat. tit. 27A, § 27A-2-10-103","heading":"Definitions","body":"As used in the Oklahoma Solid Waste Management Act:\n\n1. \"Advanced plastic recycling\" means a manufacturing process\n\nfor the conversion of post-use polymers and recovered feedstocks\n\ninto basic hydrocarbon raw materials, feedstocks, chemicals, liquid\n\nfuels and other products like waxes and lubricants through processes\n\nthat include pyrolysis, gasification, depolymerization, catalytic\n\ncracking, reforming, hydrogenation, solvolysis and other similar\n\ntechnologies. The recycled products produced at advanced recycling\n\nfacilities include, but are not limited to, monomers, oligomers,\n\nplastics, plastics and chemical feedstocks, basic and unfinished\n\nchemicals, crude oil, naphtha, liquid transportation fuels, waxes,\n\nlubricants, coatings and other basic hydrocarbons. If properly\n\nconducted, advanced recycling shall not be considered disposal, as\n\ndefined in Section 2-10-103 of this title, solid waste management\n\nsystem, as defined in this section, or incineration. For the\n\npurpose of advanced plastic recycling:\n\na. \"Depolymerization\" means a manufacturing process where\n\npost-use polymers as defined in this section are\n\nbroken into smaller molecules such as monomers and\n\noligomers or raw, intermediate or final products,\n\nplastics and chemical feedstocks, basic and unfinished\n\nchemicals, crude oil, naphtha, liquid transportation\n\nfuels, waxes, lubricants, coatings and other basic\n\nhydrocarbons,\n\nb. \"Gasification\" means a manufacturing process through\n\nwhich recovered feedstocks are heated and converted\n\ninto a fuel and gas mixture in an oxygen-deficient\n\natmosphere and the mixture is converted into valuable\n\nraw, intermediate and final products including, but\n\nnot limited to, plastic monomers, chemicals, waxes,\n\nlubricants, chemical feedstocks, crude oil, diesel,\n\ngasoline and diesel and gasoline blendstocks, home\n\nheating oil and other fuels including ethanol and\n\ntransportation fuel that are returned to economic\n\nutility in the form of raw materials, products or\n\nfuels,\n\nc. \"Pyrolysis\" means a manufacturing process through\n\nwhich post-use polymers are heated in the absence of\n\noxygen until melted and thermally decomposed and then\n\ncooled, condensed and converted into valuable raw,\n\nintermediate and final products including, but not\n\nlimited to, plastic monomers, chemicals, waxes,\n\nlubricants, chemical feedstocks, crude oil, diesel,\n\ngasoline and diesel and gasoline blendstocks, home\n\nheating oil and other fuels including ethanol and\n\ntransportation fuel that are returned to economic\n\nutility in the form of raw materials, products or\n\nfuels,\n\nd. \"Solvolysis\" means a manufacturing process through\n\nwhich post-use plastics are reacted with the aid of\n\nsolvents while heated at low temperatures, sometimes\n\nbeing pressurized, to make useful products while\n\nallowing additives and contaminants to be separated.\n\nThe products of solvolysis include, but are not\n\nlimited to, monomers, intermediates and valuable raw\n\nmaterials. The process includes, but is not limited\n\nto, hydrolysis, aminolysis, ammonoloysis,\n\nmethanolysis, ethanolysis and glycolysis;\n\n2. \"Advanced plastic recycling facility\" means a manufacturing\n\nfacility that receives, stores and converts post-use polymers and\n\nrecovered feedstocks it receives using advanced recycling. An\n\nadvanced recycling facility shall be subject to applicable\n\nDepartment of Environmental Quality regulations for air, water,\n\nwaste and land use. Advanced recycling facilities shall not be\n\nconsidered disposal sites, solid waste management systems, transfer\n\nstations as defined in this section or incineration. Advanced\n\nrecycling facilities shall be subject to inspections by the\n\nDepartment to ensure compliance with applicable laws and\n\nregulations. If an advanced recycling facility does not comply with\n\nthe requirements of this definition, it shall not be considered an\nshall not be\n\nconsidered disposal sites, solid waste management systems, transfer\n\nstations as defined in this section or incineration. Advanced\n\nrecycling facilities shall be subject to inspections by the\n\nDepartment to ensure compliance with applicable laws and\n\nregulations. If an advanced recycling facility does not comply with\n\nthe requirements of this definition, it shall not be considered an\n\nadvanced recycling facility and is subject to all applicable solid\n\nwaste laws and regulations as determined by the Department;\n\n3. \"Affiliated person\" means:\n\na. any officer, director or partner of the applicant,\n\nb. any person employed by the applicant as general or key\n\nmanager who directs the operations of the site,\n\ntransfer station or facility which is the subject of\n\nthe application, or\n\nc. any person owning or controlling more than five\n\npercent (5%) of the applicant's debt or equity;\n\n4. \"Commercial composting facility\" means a composting facility\n\nthat:\n\na. is not owned or operated by a governmental entity,\n\nb. receives one hundred (100) tons or more per year of\n\nmaterial for composting, any part of which consists of\n\nfood waste, and\n\nc. principally accepts material for composting that is\n\nnot agricultural in origin;\n\n5. \"Composting facility\" means a facility in which material is\n\nconverted, under thermophilic conditions, to a product with a high\n\nhumus content for use as a soil amendment or to prevent or remediate\n\npollutants in soil, air or stormwater run-off;\n\n6. \"Disclosure statement\" means a written statement by the\n\napplicant which contains:\n\na. the full name, business address and Social Security\n\nnumber of the applicant and all affiliated persons,\n\nb. the full name and business address of any legal entity\n\nin which the applicant holds a debt or equity interest\n\nof at least five percent (5%) or which is a parent\n\ncompany or subsidiary of the applicant and a\n\ndescription of the ongoing organizational\n\nrelationships as they may impact operations within the\n\nstate,\n\nc. a description of the experience and credentials of the\n\napplicant including any past or present permits,\n\nlicenses, certifications or operational authorizations\n\nrelating to environmental regulation,\n\nd. a listing and explanation of any administrative, civil\n\nor criminal legal actions against the applicant and\n\naffiliated person which resulted in a final agency\n\norder or final judgment by a court of record including\n\nfinal order or judgment on appeal, in the ten (10)\n\nyears immediately preceding the filing of the\n\napplication relating to solid or hazardous waste.\n\nSuch action shall include, without limitations, any\n\npermit denial or any sanction imposed by a state\n\nregulatory agency or the United States Environmental\n\nProtection Agency, and\n\ne. a listing of any federal environmental agency and any\n\nstate environmental agency that has or has had\n\nregulatory responsibility over the applicant;\n\n7. \"Disposal site\" means any place including, but not limited\n\nto, a transfer station or a roofing material recycling facility, at\n\nwhich solid waste is dumped, abandoned or accepted or disposed of by\n\nincineration, land filling, composting, shredding, compaction,\n\nbaling or any other method or by processing by pyrolysis, resource\n\nrecovery or any other method, technique or process designed to\n\nchange the physical, chemical or biological character or composition\n\nof any solid waste so as to render such waste safe or nonhazardous,\n\namenable to transport, recovery or storage or reduced in volume. A\n\ndisposal site shall not include a manufacturing facility which\n\nprocesses scrap materials which have been separated for collection\n\nand processing as industrial raw materials;\n\n8. \"Dwelling\" means a permanently-constructed, habitable\n\nstructure designed and constructed for full-time occupancy in all\n\nweather conditions, which is not readily mobile and shall include\nstorage or reduced in volume. A\n\ndisposal site shall not include a manufacturing facility which\n\nprocesses scrap materials which have been separated for collection\n\nand processing as industrial raw materials;\n\n8. \"Dwelling\" means a permanently-constructed, habitable\n\nstructure designed and constructed for full-time occupancy in all\n\nweather conditions, which is not readily mobile and shall include\n\nbut not be limited to a manufactured home as such term is defined by\n\nparagraph 17 of Section 1102 of Title 47 of the Oklahoma Statutes;\n\n9. \"Final closure\" means those measures for providing final\n\ncapping material, proper drainage, perennial vegetative cover,\n\nmaintenance, monitoring and other closure actions required for the\n\nsite by rules of the Board;\n\n10. \"Inert waste\" means any solid waste that is insoluble in\n\nwater, chemically inactive, that will not leach contaminants, or is\n\ncommonly found as a significant percentage of residential solid\n\nwaste;\n\n11. \"History of noncompliance\" means any past operations by an\n\napplicant or affiliated persons which clearly indicate a reckless\n\ndisregard for environmental regulation or a demonstrated pattern of\n\nprohibited conduct which could reasonably be expected to result in\n\nadverse environmental impact if a permit were issued, as evidenced\n\nby findings, conclusions and rulings of any final agency order or\n\nfinal order or judgment of a court of record;\n\n12. \"Integrated solid waste management plan\" means a plan that\n\nprovides for the integrated management of all solid waste within the\n\nplanning unit and embodies sound principles of solid waste\n\nmanagement, natural resources conservation, energy production and\n\nemployment-creating opportunities;\n\n13. \"Lithified earth material\" means all rock including all\n\nnaturally occurring and naturally formed aggregates or masses of\n\nminerals or small particles of older rock that formed by\n\ncrystallization of magma or by induration of loose sediments. The\n\nterm lithified earth material shall not include man-made materials,\n\nsuch as fill, concrete, and asphalt, or unconsolidated earth\n\nmaterials, soil or regolith lying at or near the earth's surface;\n\n14. \"Maximum horizontal acceleration in lithified earth\n\nmaterial\" means the maximum expected horizontal acceleration\n\ndepicted on a seismic hazard map, with a ninety percent (90%) or\n\ngreater probability that the acceleration will not be exceeded in\n\ntwo hundred fifty (250) years, or the maximum expected horizontal\n\nacceleration based on a site-specific seismic risk assessment;\n\n15. \"Monofill\" means a landfill which is used to dispose of a\n\nsingle type of specified nonhazardous industrial solid waste, except\n\nfor other nonhazardous industrial solid wastes which are not readily\n\nseparable from the specified waste;\n\n16. \"Nonhazardous industrial solid waste\" means any of the\n\nfollowing wastes deemed by the Department to require special\n\nhandling:\n\na. unusable industrial or chemical products,\n\nb. solid waste generated by the release of an industrial\n\nproduct to the environment, or\n\nc. solid waste generated by a manufacturing or industrial\n\nprocess.\n\nThe term nonhazardous industrial solid waste shall not include waste\n\nthat is regulated as hazardous waste or is commonly found as a\n\nsignificant percentage of residential solid waste;\n\n17. \"Person\" means any individual, corporation, company, firm,\n\npartnership, association, trust, state agency, government\n\ninstrumentality or agency, institution, county, any incorporated\n\ncity or town or municipal authority or trust in which any\n\ngovernmental entity is a beneficiary, venture or other legal entity\n\nhowever organized;\n\n18. \"Post-use polymer\" means a plastic:\n\na. that is derived from any industrial, commercial,\n\nagricultural or domestic activities,\n\nb. that is not mixed with solid waste or hazardous waste\nstrumentality or agency, institution, county, any incorporated\n\ncity or town or municipal authority or trust in which any\n\ngovernmental entity is a beneficiary, venture or other legal entity\n\nhowever organized;\n\n18. \"Post-use polymer\" means a plastic:\n\na. that is derived from any industrial, commercial,\n\nagricultural or domestic activities,\n\nb. that is not mixed with solid waste or hazardous waste\n\nonsite or during processing at the advanced recycling\n\nfacility,\n\nc. that the use or intended use of the plastic is as a\n\nfeedstock for the manufacturing of crude oil, fuels,\n\nfeedstocks, blendstocks, raw materials or other\n\nintermediate products or final products using advanced\n\nrecycling,\n\nd. that has been sorted from nonhazardous solid waste but\n\nmay still contain residual amounts of nonhazardous\n\nsolid waste such as organic material and incidental\n\ncontaminants or impurities, and\n\ne. that is processed at an advanced recycling facility or\n\nheld at such facility prior to processing.\n\nPost-use polymer shall not be considered solid waste as defined in\n\nthis section, unless the post-use polymer is improperly managed,\n\nabandoned or disposed of;\n\n19. \"Recovered feedstock\" means one or more of the following\n\nmaterials that has been processed so that it may be used as\n\nfeedstock in an advanced recycling facility:\n\na. post-use polymers, and/or\n\nb. scrap materials which are source separated for\n\ncollection and processing as industrial raw materials\n\nfor intended use at an advanced recycling facility,\n\nc. materials for which the United States Environmental\n\nProtection Agency has made a nonwaste determination,\n\nor has otherwise determined are feedstocks and not\n\nsolid waste, and\n\nd. recovered feedstock shall not include waste tires,\n\nwhich shall remain governed by the Section 2-11-401 et\n\nseq. of this title.\n\nRecovered feedstock shall not include unprocessed municipal\n\nsolid waste or any material mixed with solid waste or hazardous\n\nwaste at an advanced recycling facility Recovered feedstock shall\n\nnot include any materials that are specifically regulated as a solid\n\nwaste. If recovered feedstock is accumulated in anticipation of\n\nfuture markets or is stored in a quantity exceeding that which may\n\nbe reasonably expected to be used or recycled within one (1) year,\n\nthe material shall be regulated as a solid waste. Recovered\n\nfeedstock shall not be considered \"waste\" or \"solid waste\", unless\n\nthe recovered feedstock is improperly managed, abandoned or disposed\n\nof;\n\n20. \"Recycling\" means to reuse a material that would otherwise\n\nbe disposed of as waste, with or without reprocessing;\n\n21. \"Roofing Material\" means all material associated with a\n\nroofing project that is debris or is otherwise not intended for\n\nfuture use by the roofer or the property owner including but not\n\nlimited to shingles made from asphalt, fiberglass, composite or\n\nwood, as well as decking, flashing, fasteners, insulation and\n\nassociated packaging materials;\n\n22. \"Roofing material recycling facility\" means a site or\n\nfacility at which roofing material is processed for alternative\n\nuses, or is accumulated for the purpose of processing or selling all\n\nor parts of the roofing material for alternative uses including but\n\nnot limited to road construction;\n\n23. \"Seismic impact zone\" means an area with a ten percent\n\n(10%) or greater probability that the maximum horizontal\n\nacceleration in lithified earth material, expressed as a percentage\n\nof the earth's gravitational pull (g), will exceed 0.10g in two\n\nhundred fifty (250) years;\n\n24. \"Solid waste\" means all putrescible and nonputrescible\n\nrefuse in solid, semisolid or liquid form including, but not limited\n\nto, garbage, rubbish, ashes or incinerator residue, street refuse,\n\ndead animals, demolition wastes, construction wastes, roofing\n\nmaterial, solid or semisolid commercial and industrial wastes\ngravitational pull (g), will exceed 0.10g in two\n\nhundred fifty (250) years;\n\n24. \"Solid waste\" means all putrescible and nonputrescible\n\nrefuse in solid, semisolid or liquid form including, but not limited\n\nto, garbage, rubbish, ashes or incinerator residue, street refuse,\n\ndead animals, demolition wastes, construction wastes, roofing\n\nmaterial, solid or semisolid commercial and industrial wastes\n\nincluding explosives, biomedical wastes, chemical wastes, herbicide\n\nand pesticide wastes. The term solid waste shall not include:\n\na. scrap materials not including roofing materials which\n\nare source separated for collection and processing as\n\nindustrial raw materials, except when contained in the\n\nwaste collected by or in behalf of a solid waste\n\nmanagement system,\n\nb. used motor oil, which shall not be considered to be a\n\nsolid waste, but shall be considered a deleterious\n\nsubstance, if the used motor oil is recycled for\n\nenergy reclamation and is ultimately destroyed when\n\nrecycled, or\n\nc. post-use polymers or recovered feedstocks that are\n\nprocessed at an advanced recycling facility or are\n\nheld at such facility prior to processing to ensure\n\nproduction is not interrupted, unless post-use\n\npolymers or recovered feedstocks are improperly\n\nmanaged, abandoned or disposed of;\n\n25. \"Solid waste management system\" means the system that may\n\nbe developed for the purpose of collection and disposal of solid\n\nwaste by any person engaging in such process as a business or by any\n\nmunicipality, authority, trust, county or by any combination thereof\n\nat one or more disposal sites;\n\n26. \"Solid waste planning unit\" means any county or any part\n\nthereof, incorporated city or town, or municipal authority or trust\n\nin which any governmental entity is a beneficiary, venture or other\n\nlegal entity however organized, which the Department determines to\n\nbe capable of planning and implementing an integrated solid waste\n\nmanagement program;\n\n27. \"Transfer station\" means any disposal site, processing\n\nfacility or other place where solid waste is transferred from a\n\nvehicle or container to another vehicle or container for\n\ntransportation including but not limited to a barge or railroad\n\nunloading facility where solid waste, in bulk or in containers, is\n\nunloaded, stored, processed or transported for any purpose. The\n\nterm transfer station shall not include the following:\n\na. a facility, such as an apartment complex or a large\n\nmanufacturing plant, where the solid waste that is\n\ntransferred has been generated by the occupants,\n\nresidents or functions of the facility,\n\nb. a citizens' collection station, or\n\nc. a waste collection system which leaves collected solid\n\nwaste in enclosed containers along the collection\n\nroute for later transport to a recycling or disposal\n\nfacility serving the area; and\n\n28. \"Waste reduction\" means to reduce the volume of waste\n\nrequiring disposal.","path":["OK Code","Title 27A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os27A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"8cbd6459c161ec854e3414eed93b90affdb47c1ee8e71bb8151232985f404f4f","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-27a-27a-2-10-102","next":"us-ok/okla.-stat.-tit.-27a-27a-2-10-201"},"notice":"GroundRules: Original legal text.
