Stat. tit. 27A, § 27A-2-10-202","heading":"Powers and duties of Department of Environmental","body":"Quality.\n\nA. The Department of Environmental Quality shall have the power\n\nand duty to:\n\n1. Advise, consult and cooperate with other agencies and\n\ninstrumentalities of the state, other states and the federal\n\ngovernment and with affected groups and industries in the\n\nformulation of plans and the implementation of the solid waste\n\ndisposal program;\n\n2. Administer and make available such loans and grants from the\n\nfederal government and from other sources as may be available to the\n\nDepartment for the planning, construction, and operation of solid\n\nwaste disposal sites;\n\n3. Develop a statewide integrated solid waste management plan\n\nwith input from the public, municipal and county governments and\n\nregional solid waste planning and management entities;\n\n4. Review and act upon applications for solid waste disposal\n\nsite permits, inspect construction, operation, closure and\n\nmaintenance of solid waste disposal sites and establish standards\n\nfor and oversee the remediation of contaminated soils resulting from\n\nreleases or spills associated with transit or other activities not\n\nsubject to permitting requirements and not subject to the\n\njurisdiction of another state environmental agency;\n\n5. Perform investigations and inspections which it deems\n\nnecessary to ensure compliance with the Oklahoma Environmental\n\nQuality Code, the Oklahoma Solid Waste Management Act and rules\n\npromulgated thereunder and orders, permits and licenses issued\n\npursuant thereto;\n\n6. Provide technical assistance to solid waste planning units,\n\npublic solid waste management service entities, political\n\nsubdivisions, business and industry, and the general public to\n\npromote development and implementation of recycling activities to\n\nmeet the goals of the Oklahoma Solid Waste Management Act;\n\n7. Establish and maintain, or cause to be established and\n\nmaintained, in cooperation with the Department of Commerce, a\n\ndatabase for tracking markets for materials which are being or could\n\nbe recovered from the municipal solid waste stream in Oklahoma. The\n\ndatabase shall contain information including but not limited to the\n\nnames and addresses of buyers and sellers of secondary materials\n\nrelevant to Oklahoma, market prices, and specifications required by\n\nbuyers;\n\n8. Establish an office for local solid waste systems\n\ndevelopment and coordination; and\n\n9. Establish a certification program for control officers\n\nemployed by regional solid waste management districts within this\n\nstate or governments or county government instrumentalities within\n\nthis state who are responsible for the investigation and enforcement\n\nof the laws of this state relating to illegal dumps. Such certified\n\ncontrol officers shall have the authority to investigate and report\n\nviolations to the proper authority pursuant to the provisions of\n\nSection 1761.1 of Title 21 of the Oklahoma Statutes.\n\nB. Any local governing body may by ordinance or resolution\n\nadopt standards for the location, design, construction, and\n\nmaintenance of solid waste disposal sites and facilities more\n\nrestrictive than those promulgated by the Board under the provisions\n\nof the Oklahoma Solid Waste Management Act.","path":["OK Code","Title 27A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os27A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"15f3644d83870ce79019133987274027b05f1d49754e73e46d533f317f897c51","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-27a-27a-2-10-201","next":"us-ok/okla.-stat.-tit.-27a-27a-2-10-203"},"notice":"GroundRules: Original legal text.
