The Legislature hereby recognizes and declares that it is\n\nnecessary for the public interest, health and economic welfare to\n\nencourage and promote the recycling and reuse of recoverable\n\nmaterials. The recycling and reuse of recoverable materials\n\nsubstantially reduces disposal costs and the tremendous flow of\n\nsolid waste to Oklahoma's dwindling solid waste sites. It is\n\nequally necessary that Oklahoma preserve, expand and encourage\n\neconomic growth. The recycling and reuse of recoverable materials\n\nwill create new employment, provide and allow for expansion of\n\nexisting manufacturing, thereby increasing employment and payrolls\n\nas well as upgrading the state's natural resources.\n\nB. In addition to the benefits of cost-effective recycling and\n\nreuse outlined in subsection A of this section, the measurable\n\nenergy efficiency achieved through the cost-effective recovery and\n\nreuse of recyclable materials by energy-intensive industries shall\n\nbe a priority of this state and encouraged by state regulatory\n\nagencies. For purposes of this section, \"energy-intensive industry\"\n\nmeans an industry that uses significant quantities of energy as part\n\nof its primary economic activities and includes the following\n\nindustries:\n\n1. Information technology, including data centers containing\n\nelectrical equipment used in processing, storing and transmitting\n\ndigital information;\n\n2. Consumer product manufacturing;\n\n3. Food processing; and\n\n4. Materials manufacturers, including aluminum, chemicals,\n\nforest and paper products, metal casting, glass, petroleum refining,\n\nmining and steel.\n\nC. The Legislature declares that the goal of this state,\n\nhereinafter called the Oklahoma Recycling Initiative, is that each\n\nincorporated municipality with a population greater than five\n\nthousand (5,000), as determined by the most recent decennial census\n\nby the Bureau of the Census of the United States Department of\n\nCommerce, should develop and operate a recycling program which will\n\ngenerate raw materials for the manufacturing industries located in\n\nthis state. Due to the importance of the paper industry to\n\nOklahoma's economy, each cost-effective recycling and reuse program\n\nshould at a minimum include the collection of waste paper.\n\nIn implementing any recycling program pursuant to the Oklahoma\n\nRecycling Initiative, the municipality may:\n\n1. Consider the overall status of the solid waste collection\n\nsystem and management within the municipality, including generation,\n\nrecycling and disposal;\n\n2. Review five-, ten-, and twenty-year municipality-wide goals\n\nfor reducing the amount of solid waste through the recycling of\n\nrecoverable materials;\n\n3. Evaluate alternative methods for achieving the Oklahoma\n\nRecycling Initiative through municipality-wide collection systems or\n\nthrough integrated recoverable materials management on a regional\n\nbasis;\n\n4. Establish a comprehensive and sustained public information\n\nand education program concerning the recoverable materials program's\n\nfeatures and requirements; and\n\n5. Include in the program such other information recommended by\n\nthe Department of Environmental Quality.\n\nD. The Legislature in an effort to increase statewide recycling\n\nefforts hereby encourages a goal of recycling ten percent (10%) of\n\nthe entire solid waste stream produced in this state by December 31,\n\n2011. The Department of Environmental Quality shall coordinate this\n\neffort with the Oklahoma Recycling Association (OKRA) and any other\n\ninterested parties and issue a report to the Legislature by December\n\n31, 2011.","path":["OK Code","Title 27A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os27A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"d4a8f434f31536fb7888789913cc882fa58494d58efe1058a190877f97cbcb9c","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-27a-27a-2-10-203","next":"us-ok/okla.-stat.-tit.-27a-27a-2-10-205.1"},"notice":"GroundRules: Original legal text.
