Stat. tit. 27A, § 27A-2-10-301","heading":"Permit required - Exemptions - Remediation projects","body":"A. Except as otherwise specified in this section:\n\n1. No person shall dispose of solid waste at any site or\n\nfacility other than a site or facility for which a permit for solid\n\nor hazardous waste disposal has been issued by the Department of\n\nEnvironmental Quality;\n\n2. No person shall own or operate a site or facility at which\n\nsolid waste is disposed other than a site or facility for which a\n\npermit for solid or hazardous waste disposal has been issued by the\n\nDepartment;\n\n3. No person shall knowingly transport solid waste to an\n\nunpermitted site or facility; and\n\n4. The Department shall not bring an enforcement action against\n\nany unit of local government which undertakes any remediation of an\n\nillegal dump which the local government had no role in creating\n\nprovided that the unit of local government first consults with and\n\nfollows the remediation advice of the Department. The Department is\n\nauthorized to recommend remediation of illegal dumps by burial of\n\nthe material on location, when such burial appears to pose less risk\n\nthan failure to remediate.\n\nB. No provision of the Oklahoma Solid Waste Management Act\n\nshall be construed to prevent a person from disposing of solid waste\n\nfrom his or her household upon his or her property provided such\n\ndisposal does not create a nuisance or a hazard to the public health\n\nor environment or does not violate a local government ordinance.\n\nC. Notice of permit actions shall be in accordance with the\n\nUniform Permitting Act.\n\nD. The Department shall issue a permit to be effective for the\n\nlife of a given landfill site. The Environmental Quality Board may\n\npromulgate rules regarding permit requirements for the commencement\n\nof construction and operation of disposal sites. The rules\n\npromulgated by the Board for the commencement of construction and\n\noperation of landfill sites shall not apply to sites permitted prior\n\nto the effective date of this act. For sites using new technology,\n\nthe Department may issue research and development permits to be\n\neffective for specified periods of time. In order to assure\n\nadequate financial assurance as required by this section, each\n\npermittee who operates a landfill disposal site, other than a\n\ngenerator owned and operated private industrial nonhazardous\n\nmonofill, shall submit information on an annual basis at such times\n\nand in such form as the Department shall require, sufficient to\n\nallow the Department to know the remaining landfill life.\n\nE. Information and data submitted in support of a permit\n\napplication or a permit modification application for any site\n\nserving a population equivalent of five thousand (5,000) or more\n\npersons shall be prepared and sealed by a professional engineer\n\nlicensed to practice in this state. Applicants for smaller site\n\npermits are encouraged but not required to seek professional\n\nengineering assistance.\n\nF. The Department shall not issue any permit for the siting or\n\nexpansion of an asbestos monofill which will be located closer than\n\nfive hundred (500) yards from any occupied residence. No asbestos\n\nmonofill shall be constructed within three (3) miles of the\n\ncorporate boundaries of any city or town.\n\nG. Disposal sites approved by the Department to receive only\n\nsolid waste shall not accept for disposal any waste classified as\n\nhazardous waste.\n\nH. No permit shall be required for a disposal site constructed\n\npursuant to an order issued by the Department in an effort to\n\nremediate an abandoned or inactive waste site. Such disposal site\n\nshall only receive waste from the remediation project, and shall be\n\ndesigned, constructed, and operated in accordance with the technical\n\nstandards established in the applicable rules promulgated by the\n\nEnvironmental Quality Board. The Department shall not issue any permit for the siting of\n\na new municipal solid waste landfill in any location that is both:\n\n1. Within a locally fractured or cavernous limestone or cherty\n\nlimestone bedrock; and\n\n2. Within five (5) miles of any water well owned by a rural\n\nwater district that is used or has the potential to be used to\n\nprovide water to customers of the district.\n\nJ.
