Except as provided in paragraph 2 of this subsection,\n\nall applicants for the issuance or transfer of any solid waste\n\npermit, license, certification or operational authority shall file a\n\ndisclosure statement with their applications.\n\n2. If the applicant is a publicly held company required to file\n\nperiodic reports under the Securities and Exchange Act of 1934, or a\n\nwholly owned subsidiary of a publicly held company, the applicant\n\nshall not be required to submit a disclosure statement, but shall\n\nsubmit the most recent annual and quarterly reports required by the\n\nSecurities and Exchange Commission, which provide information\n\nregarding legal proceedings in which the applicant has been\n\ninvolved. The applicant shall submit such other information as the\n\nDepartment of Environmental Quality may require pursuant to this\n\nsection that relates to the competency, reliability, or\n\nresponsibility of the applicant and affiliated persons.\n\nB. The Department is authorized to revoke or to refuse to\n\nissue, amend, modify, renew or transfer a permit for the disposal of\n\nsolid waste from or to any person or an affiliated person who:\n\n1. Is not, due solely to the applicant's actions or inactions,\n\nin substantial compliance with any final agency order or final order\n\nor judgment of a court of record secured by the Department issued\n\npursuant to the provisions of the Oklahoma Solid Waste Management\n\nAct; or\n\n2. Is not in substantial compliance with any final agency order\n\nor final order or judgment of a court of record secured by any state\n\nor federal agency, as determined by that agency, relating to the\n\nstorage, transfer, transportation, treatment or disposal of any\n\nsolid waste; or\n\n3. Has evidenced a history of a reckless disregard for the\n\nprotection of the public health and safety or the environment\n\nthrough a history of noncompliance with state or federal\n\nenvironmental laws, including without limitation the rules of the\n\nDepartment, regarding the storage, transfer, transportation,\n\ntreatment or disposal of any solid or hazardous waste.\n\nC. The application shall be signed under oath by the applicant.\n\nD. The Department may suspend or revoke a permit issued\n\npursuant to the Oklahoma Solid Waste Management Act to any person\n\nwho has failed to disclose or states falsely any information\n\nrequired pursuant to the provisions of this section.\n\nE. Any person who willfully fails to disclose or states falsely\n\nany such information, upon conviction, shall be guilty of a Class D1\n\nfelony offense and shall be punished by imprisonment as provided for\n\nin subsections B through F of Section 20N of Title 21 of the\n\nOklahoma Statutes, or a fine of not more than One Hundred Thousand\n\nDollars ($100,000.00), or both such fine and imprisonment.\n\nF.
