Requests for variances from specific requirements of any\n\nparticular rule must be made a part of the permit application of any\n\napplicant and the opportunity to request a public meeting or\n\nadministrative permit hearing, or both, shall have been offered\n\nprior to authorization of the variance to any applicant, including\n\nany unit of government. Further, any application for a variance for\n\nsubstitute technology which equals or exceeds the protection\n\naccorded by the particular rule shall not be granted unless an\n\nopportunity to request a public meeting or administrative permit\n\nhearing, or both, has been offered.\n\nB. Except as otherwise provided in this subsection, the\n\nDepartment shall not approve a variance from the rules of the Board\n\nfor a solid waste disposal site to be located within any one-hundred\n\nyear flood plain unless the variance is conditioned upon the\n\nsubsequent redefinition of the one-hundred year plain to not include\n\nthe land area proposed for the variance. A variance may be granted\n\nfor the siting of a solid waste transfer station within a one-\n\nhundred year flood plain conditioned upon the requirement that no\n\nsolid waste will be retained or stored by any means during\n\nnonoperating hours on any portion of the permitted site that is\n\nwithin the one-hundred year flood plain.","path":["OK Code","Title 27A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os27A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"fc6ba10e4f9790cbdfc46dbf63962a5c5c61ca245269f86c287da7f272c98ac7","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-27a-27a-2-10-303.1","next":"us-ok/okla.-stat.-tit.-27a-27a-2-10-306"},"notice":"GroundRules: Original legal text.
