In order to protect public health and preserve the\n\nexpectation of future disposal capability of areas local to a\n\ndisposal site, except as otherwise provided by this section, no\n\ndisposal site shall accept more than two hundred (200) tons per day\n\nof solid waste generated more than fifty (50) miles from the\n\ndisposal site unless a permit application for a new disposal site is\n\nsubmitted and approved by the Department for such waste.\n\nThe waste generated within the fifty-mile local area shall not\n\nbe considered in calculating the two-hundred-ton limit.\n\nB. New and existing landfills, incinerators, or other sites\n\ndesigned, constructed and operated in accordance with the most\n\nenvironmentally protective solid waste regulations adopted by the\n\nBoard shall be subject to neither the two-hundred-ton nor the fifty-\n\nmile limit.\n\nC. The Department may grant a temporary waiver to the limit\n\nspecified in this section in the event of an emergency. Any such\n\nwaiver so granted may be conditioned on development of additional\n\ncapacity in the area where the waste is generated.\n\nD. Before any disposal site accepts for disposal any solid\n\nwaste generated outside the territorial limits of this state in\n\nexcess of two hundred (200) tons per day:\n\n1. The operator of the disposal site shall submit to the\n\nDepartment for approval a disposal plan prepared by either the\n\ngenerator or shipper as set out in the rules promulgated by the\n\nBoard. Such plans as a minimum shall indicate the type and amount\n\nof solid waste generated, the handling, storage, treatment, disposal\n\nmethod and the disposal site to be used. The disposal plans shall\n\nbe kept current by the persons submitting the original disposal\n\nplans and the Department shall be advised not less than five (5)\n\nworking days prior to the day on which such changes are to be\n\nimplemented.\n\nPersons storing or shipping recyclable materials in an\n\nenvironmentally acceptable manner for the purpose of recycling shall\n\nbe required to file disposal plans required by this subsection only\n\nfor those wastes which are to be disposed.\n\n2. The disposal site shall be designed, constructed and\n\noperated in accordance with the most environmentally protective\n\nsolid waste rules promulgated by the Board. For landfills, the most\n\nenvironmentally protective solid waste regulations shall be any of\n\nthose regulations promulgated by the Board for the largest\n\npopulation category and which include leachate collection in the\n\nlandfill design, and which were effective when the application for\n\ndisposal plan approval was filed with the Department.\n\nE. Operators of solid waste disposal sites shall reject\n\nshipments of solid waste brought into this state which do not meet\n\nall the applicable requirements of this section. All rejected solid\n\nwaste shall be taken out of state by the same persons who brought it\n\ninto this state in violation of the provisions of this section.\n\nF. Fly ash and bottom ash generated by coal-fired facilities\n\nlocated outside the territorial limits of this state in excess of\n\ntwo hundred (200) tons per day shall be constructively reutilized or\n\ndisposed of only in an active or inactive mining operation subject\n\nto the provisions contained in Title 45 of the Oklahoma Statutes.\n\nG. Willful violation of this section shall constitute a Class\n\nD1 felony offense punishable by a fine of not more than Ten Thousand\n\nDollars ($10,000.00), or imprisonment as provided for in subsections\n\nB through F of Section 20N of Title 21 of the Oklahoma Statutes, or\n\nboth such fine and imprisonment.","path":["OK Code","Title 27A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os27A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"9f66c546bcb1d54edae5f0816dcf4a6f22e0b1e83855c65de7c67b6167132be5","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-27a-27a-2-10-701","next":"us-ok/okla.-stat.-tit.-27a-27a-2-10-801.1"},"notice":"GroundRules: Original legal text.
