Stat. tit. 27A, § 27A-2-10-802.2","heading":"Required components of a roofing material","body":"recycling facility.\n\nA. In addition to meeting the requirements of the Oklahoma\n\nSolid Waste Management Act generally applicable to solid waste\n\ndisposal sites, including but not limited to permitting, disclosure\n\nstatement, siting, closure plan and financial assurance, the owner\n\nor operator of a roofing material recycling facility shall:\n\n1. Install scales, weigh roofing material received and record\n\nweights in accordance with the provisions of paragraphs 1 and 2 of\n\nsubsection A of Section 2-10-802 of Title 27A of the Oklahoma\n\nStatutes;\n\n2. Assess a fee of One Dollar and fifty cents ($1.50) per ton\n\nof roofing material received, retaining twenty-five cents ($0.25)\n\nper ton for a period of time necessary to recoup a capital\n\ninvestment plus the interest costs expended in purchasing the\n\nscales, of Forty Thousand Dollars ($40,000.00). At the end of such\n\nperiod the fee shall revert to One Dollar and twenty-five cents\n\n($1.25) per ton;\n\n3. Remit the fee to the Department of Environmental Quality in\n\naccordance with the provisions of paragraphs 7 through 12 of\n\nsubsection B of Section 2-10-802 of Title 27A of the Oklahoma\n\nStatutes. For a return with remittance filed on or before the due\n\ndate, the owner or operator may deduct and retain ten percent (10%)\n\nof the fees collected. Records documenting the capital investment\n\nand the use of the funds shall be included with each return; and\n\n4. Submit receipts for the payment for disposal of non-\n\nrecyclable materials at a permitted landfill or solid waste disposal\n\nsite in order to receive credit against the fee owed to the\n\nDepartment of Environmental Quality for that tonnage.\n\nB. An operation otherwise meeting the definition of a roofing\n\nmaterial recycling facility but that is included within and\n\nregulated under a permit for a solid waste land disposal site is not\n\nsubject to the provisions of this section.\n\nC.
