Stat. tit. 27A, § 27A-2-10-805","heading":"Solid Waste Facility Emergency Closure Fund Special","body":"Account.\n\nA. There is hereby created in the State Treasury a revolving\n\nfund for the Department of Environmental Quality to be designated\n\nthe \"Solid Waste Facility Emergency Closure Fund Special Account\".\n\nThe fund account shall be a continuing fund account, not subject to\n\nfiscal year limitations. All monies accruing to the credit of said\n\nfund account are hereby appropriated and may be budgeted and\n\nexpended by the Department for the purpose specified by this\n\nsection.\n\nB. The fund shall contain only monies appropriated by the\n\nLegislature and specifically designated for deposit to the fund.\n\nC. Expenditures from the fund account shall be made upon\n\nvouchers prescribed by the State Treasurer and issued by the\n\nDepartment against the Solid Waste Facility Emergency Closure Fund\n\nSpecial Account.\n\nD. No monies shall be expended by the Department from the Solid\n\nWaste Facility Emergency Closure Fund Special Account except for\n\nclosure and monitoring activities at landfill disposal sites where\n\nthe owner or operator has failed to adequately provide closure and\n\npostclosure care and where the financial assurance, as specified in\n\nSection 2-10-701 of this title, is insufficient to properly close or\n\nmonitor the site as required by the rules, and for any action\n\ndetermined to be necessary by the Department for the pursuit of cost\n\nrecovery as required by this section.\n\nE. The Department shall expeditiously pursue all remedies\n\navailable to compel the legally responsible parties to perform\n\nclosure and postclosure monitoring and care as required by the\n\nrules, and to seek the recovery of any funds expended by the\n\nDepartment under this section. The Department shall utilize staff\n\nor outside counsel to assure such expeditious pursuit of remedies.\n\nF.
