Stat. tit. 27A, § 27A-2-11-504","heading":"Impermissible restrictions on auxiliary containers","body":"A. As used in this section, \"auxiliary container\" means any\n\nbag, cup, package, container, bottle, device or other packaging that\n\nis:\n\n1. Made of cloth, paper, plastic, including foamed or expanded\n\nplastic, cardboard, corrugated material, aluminum, glass,\n\npostconsumer recycled material or similar material including, but\n\nnot limited to, coated or laminated materials; and\n\n2. Designed for, but not limited to, consuming, transporting,\n\nor protecting merchandise, food or beverages from, or at, a food\n\nservice facility, manufacturing, distribution, further processing,\n\nor retail facility.\n\nB. Except for subsection D of this section, no political\n\nsubdivision shall restrict, tax, prohibit or regulate the use,\n\ndisposition or sale of auxiliary containers.\n\nC. Nothing in this section shall prohibit or limit any county\n\nor municipal ordinance or agreement regarding a recycling program or\n\nthe disposal of solid waste.\n\nD.
