Stat. tit. 27A, § 27A-2-11-603","heading":"Definitions","body":"As used in the Oklahoma Computer Equipment Recovery Act:\n\n1. \"Brand\" means symbols, words, or marks that identify a\n\ncovered device, rather than any of its components;\n\n2. \"Consumer\" means any occupant of a single detached dwelling\n\nunit or a single unit of a multiple dwelling unit who has used a\n\ncovered device primarily for personal or home business use;\n\n3. \"Covered device\" means a desktop or notebook computer, or\n\ncomputer monitor which is no longer of use to a consumer. Covered\n\ndevice does not include a television, any part of a motor vehicle, a\n\npersonal digital assistant (PDA), a telephone, or a medical device\n\nthat contains a video display device;\n\n4. \"Department\" means the Department of Environmental Quality;\n\n5. \"Desktop computer\" means an electronic, magnetic, optical,\n\nelectrochemical, or other high-speed data-processing device\n\nperforming logical, arithmetic, or storage functions, but does not\n\ninclude an automated typewriter or typesetter. A desktop computer\n\nhas a main unit that is intended to be located in a permanent\n\nlocation, often on a desk or on the floor. A desktop computer is\n\nnot designed for portability and generally utilizes an external\n\nmonitor, keyboard, and mouse;\n\n6. \"Manufacturer\" means a person:\n\na. who manufactures or manufactured covered devices under\n\na brand that the manufacturer owns or owned or is or\n\nwas licensed to use, other than a license to\n\nmanufacture covered devices for delivery exclusively\n\nto or at the order of the licensor,\n\nb. who sells or sold covered devices manufactured by\n\nothers under a brand that the seller owns or owned or\n\nis or was licensed to use, other than a license to\n\nmanufacture covered devices for delivery exclusively\n\nto or at the order of the licensor,\n\nc. who manufactures or manufactured covered devices\n\nwithout affixing a brand,\n\nd. who manufactures or manufactured covered devices to\n\nwhich is or was affixed a brand that the manufacturer\n\nneither owns or owned nor is or was licensed to use,\n\nor\n\ne. for whose account covered devices, manufactured\n\noutside the United States, are or were imported into\n\nthe United States. If at the time such covered\n\ndevices are or were imported into the United States\n\nanother person has offered to collect such covered\n\ndevices under a recovery plan pursuant to subsection C\n\nof Section 5 of this act, this subparagraph shall not\n\napply.\n\nTo be subject to the provisions of this act, a manufacturer must\n\nproduce, sell or import covered devices in an amount exceeding fifty\n\nunits per year;\n\n7. \"Notebook computer\" means an electronic, magnetic, optical,\n\nelectrochemical, or other high-speed data-processing device\n\nperforming logical, arithmetic, or storage functions, but does not\n\ninclude a portable handheld calculator, or a portable digital\n\nassistant;\n\n8. \"Person\" means any individual, business entity, partnership,\n\nlimited liability company, corporation, not-for-profit corporation,\n\nassociation, governmental entity, public benefit corporation or\n\npublic authority;\n\n9. \"Recover\" means to reuse or recycle;\n\n10. \"Recoverer\" means a person or entity that reuses or\n\nrecycles;\n\n11. \"Retailer\" means a person that owns or operates a business\n\nthat sells covered devices directly to a consumer, whether or not\n\nthe seller has a physical presence in this state;\n\n12. \"Sell\" or \"sale\" means any transfer for consideration of\n\ntitle including, but not limited to, transactions conducted through\n\nsales outlets, catalogs, or the Internet or any other similar\n\nelectronic means, but does not include leases; and\n\n13. \"Television\" means any telecommunication system device that\n\ncan receive moving pictures and sound broadcast over a distance, and\n\nincludes a television tuner or a display device peripheral to a\n\ncomputer that contains a television tuner.","path":["OK Code","Title 27A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os27A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"cf4d10176c124a1bb20e83b1a732158743cb6c312443ed60227f03195c7b0344","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-27a-27a-2-11-602","next":"us-ok/okla.-stat.-tit.-27a-27a-2-11-604"},"notice":"GroundRules: Original legal text.
