The Department of Environmental Quality shall assist in\n\neducating consumers about collection and recovery of covered\n\ndevices. This shall include hosting, or designating another person\n\nto host, a web site for consumers about the collection and recovery\n\nof covered devices. The web site shall provide information about\n\nand links to manufacturers’ collection and recovery information,\n\nincluding their recovery plans, and information about and links to\n\ninformation for covered devices, including information about\n\ncollection events, collection sites, and community recycling\n\nprograms. Inclusion on such web site is not a determination by the\n\nstate that the manufacturer’s recovery plan or practices are in\n\ncompliance with this act or other laws.\n\nB. The Department shall maintain and make available:\n\n1. A list of registered manufacturers who have adopted and\n\nimplemented a recovery plan, as required by this act; and\n\n2. A separate list of manufacturers whose registered recovery\n\nplan permits consumers to return for collection and recovery other\n\nmanufacturers’ brands of covered devices, including orphan devices.\n\nManufacturers shall be included on this list of beyond-brand\n\ncollection plans if such plan:\n\na. provides recycling grants or collection events for\n\ncovered devices other than that manufacturer’s covered\n\ndevices,\n\nb. requires a consumer who purchases a new covered\n\nelectronic device from the manufacturer to return\n\nanother manufacturer’s branded covered device, in\n\nwhich case the manufacturer may require the consumer\n\nto pay for transportation or shipping, or\n\nc. provides for use of other collection or recovery\n\nmethods that are approved by the Department.\n\nC. The Department shall file each recovery plan and annual\n\nreport submitted by a manufacturer. The Department shall make\n\nrecovery plans and annual reports available to the public pursuant\n\nto the Oklahoma Open Records Act.\n\nD. The Department shall produce a schedule of collection\n\nevents, based on the manufacturers’ submitted recovery plans.\n\nE. The Department shall by July 1 of each year produce and\n\nsubmit to the Governor, the President Pro Tempore of the Senate and\n\nSpeaker of the House of Representatives a summary of the recovery\n\nprogram annual reports filed by the manufacturers.\n\nF. The Department may conduct audits and inspections to\n\ndetermine compliance with the provisions of this act and take\n\nenforcement action against any manufacturer, retailer, or recoverer\n\nfor failure to comply with any provisions of this act.\n\nG. In addition to any other remedies provided by law, the\n\nDepartment may assess a penalty of up to One Thousand Dollars\n\n($1,000.00) for the first violation, and up to Five Thousand Dollars\n\n($5,000.00) for the second and each subsequent violation, against\n\nany manufacturer who fails to label its covered devices or to adopt\n\nand implement a recovery plan as required by this act.\n\nH. The Environmental Quality Board may promulgate rules\n\nnecessary to implement the provisions of this act, including the\n\nadoption of fees pursuant to the provisions of Section 2-3-402 of\n\nTitle 27A of the Oklahoma Statutes as necessary to cover the costs\n\nof administering the program.
