No state agency shall contract for the purchase of covered\n\nelectronic devices manufactured by any manufacturer that is not on\n\nthe Department of Environmental Quality's list of registered\n\nmanufacturers or that has been otherwise determined noncompliant\n\nwith the provisions of this act.\n\nB. Any person who submits a bid for a contract with a state\n\nagency for the purchase or lease of covered devices must show that\n\nthe manufacturer of the brand of covered device is in compliance\n\nwith the Oklahoma Computer Equipment Recovery Act.\n\nC. A state agency that purchases or leases covered devices\n\nshall require each prospective bidder to certify compliance with\n\nthis act. Failure to provide such certification shall render the\n\nprospective bidder ineligible to bid on the procurement of covered\n\ndevices.\n\nD. In the case of contracts for the purchase of covered\n\nelectronic devices through a competitive process, in the event that\n\nthe bidder having the lowest price or best value offer will supply\n\ncovered electronic devices manufactured by a manufacturer that is\n\nnot included on the Department's list of manufacturers with beyond-\n\nbrand collection plans under subsection B of Section 2-11-607 of\n\nthis title and one or more other bidders will supply covered\n\nelectronic devices manufactured by a manufacturer that is included\n\non that list, the contracting entity shall award such contract to\n\nthe lowest price or best value bidder that will supply covered\n\nelectronic devices manufactured by a manufacturer that is included\n\non that list.\n\nE. The Office of Management and Enterprise Services shall\n\npromulgate rules to implement the provisions of this section.\n\nF.
