Stat. tit. 27A, § 27A-2-12-304","heading":"Issuance, renewal of certificate, accreditation -","body":"Refusal, revocation, suspension - Reapplication.\n\nA. 1. The Department shall have power to refuse to issue or\n\nrenew, in part or in whole, a certificate or accreditation or, after\n\nnotice and opportunity for an individual proceeding as provided in\n\nArticle II of the Administrative Procedures Act and the Oklahoma\n\nEnvironmental Quality Code, and rules promulgated thereunder, revoke\n\nor suspend in part or in whole any certificate or accreditation for\n\ngood cause including, but not limited to:\n\na. gross inefficiency or incompetence,\n\nb. violation of any provisions of this article, rules\n\npromulgated thereunder or the terms or conditions of\n\nany certification, accreditation or order issued\n\npursuant thereto, or\n\nc. fraud or misrepresentation in obtaining a certificate\n\nor accreditation.\n\n2. After the expiration of one (1) year after the Department's\n\ndenial of an application for a new or renewed certification or\n\naccreditation, or for a reactivated and renewed certificate, or the\n\nDepartment's revocation of a certification or accreditation, the\n\nholder of such certificate or accreditation may make application to\n\nthe Department for new certification or accreditation. After the\n\nexpiration of one (1) year after the Department's suspension of a\n\ncertification or accreditation, the holder may make application to\n\nthe Department for reinstatement or new certification or\n\naccreditation. Such new issuance or reinstatement shall rest in the\n\nsound discretion of the Department.\n\nB.
