The Board shall have the authority to promulgate rules to\n\nimplement the Oklahoma Uniform Environmental Permitting Act for each\n\ntier which will to the greatest extent possible:\n\n1. Enable applicants to follow a consistent application\n\nprocess;\n\n2. Ensure that uniform public participation opportunities are\n\noffered;\n\n3. Provide for uniformity in notices required of applicants;\n\nand\n\n4. Set forth procedural application requirements.\n\nB. Such rules shall:\n\n1. Designate applications as Tier I, II or III. In making such\n\ndeterminations, the Board and each recommending Council shall\n\nconsider information and data offered on:\n\na. the significance of the potential impact of the type\n\nof activity on the environment,\n\nb. the amount, volume and types of waste proposed to be\n\naccepted, stored, treated, disposed, discharged,\n\nemitted or land applied,\n\nc. the degree of public concern traditionally connected\n\nwith the type of activity,\n\nd. the federal classification, if any, for such proposed\n\nactivity, operation or type of site or facility, and\n\ne. any other factors relevant to such determinations;\n\n2. For purposes of this section, the Board and each\n\nrecommending Council shall ensure that such designations are\n\nconsistent with any analogous classifications set forth in\n\napplicable federal programs.\n\nC. Such rules shall for each tier:\n\n1. Set forth uniform procedures for filing an application;\n\n2. Contain specific uniform requirements for each type of\n\nnotice required by the Oklahoma Uniform Environmental Permitting\n\nAct; provided, however, that if notice and public participation\n\nopportunities are required, such requirements shall not exceed those\n\nset forth for the tier unless required otherwise by applicable\n\nfederal regulations promulgated as rules of the Board or a holding\n\nof the Oklahoma Supreme Court;\n\n3. Contain other provisions needed to implement and administer\n\nthis article; and\n\n4. Designate positions to which the Executive Director may\n\ndelegate, in writing, the power and duty to issue, renew, amend,\n\nmodify and deny permits.\n\nD.
