Upon conclusion of its technical review of a Tier II or III\n\napplication within the permitting timeframes established by rules\n\npromulgated by the Board, the Department shall prepare a draft\n\ndenial or draft permit.\n\n1. Notice of a draft denial shall be given by the Department\n\nand notice of a draft permit shall be given by the applicant.\n\n2. Notice of the draft denial or draft permit shall be\n\npublished as legal notice in one newspaper local to the proposed new\n\nsite or existing facility. The notice shall identify places where\n\nthe draft denial or draft permit may be reviewed, including a\n\nlocation in the county where the proposed new site or existing\n\nfacility is located, and shall provide for a set time period for\n\npublic comment and for the opportunity to request a formal public\n\nmeeting on the respective draft denial or draft permit. Such time\n\nperiod shall be set at thirty (30) days after the date the notice is\n\npublished unless a longer time is required by federal regulations\n\npromulgated as rules by the Board. In lieu of the notice of\n\nopportunity to request a public meeting, notice of the date, time,\n\nand place of a public meeting may be given, if previously scheduled.\n\nB.
