Stat. tit. 27A, § 27A-2-15-103","heading":"Definitions","body":"For purposes of the Oklahoma Brownfields Voluntary Redevelopment\n\nAct:\n\n1. \"Participant\" means any person who or entity which:\n\na. has acquired the ownership, operation, management, or\n\ncontrol of a site through foreclosure or under the\n\nterms of a bona fide security interest in a mortgage\n\nor lien on, or an extension of credit for, a\n\nbrownfields site and which forecloses on or receives\n\nan assignment or deed in lieu of foreclosure or other\n\nindicia of ownership and thereby becomes the owner of\n\na brownfield,\n\nb. possesses a written expression of an interest to\n\npurchase a brownfield and the ability to implement a\n\nbrownfield redevelopment proposal,\n\nc. is the legal owner in fee simple of a brownfield,\n\nd. is a tenant on or lessee of the brownfield site, or\n\ne. is undertaking the remediation of a brownfield site;\n\n2. \"Brownfield\" means an abandoned, idled or underused\n\nindustrial or commercial facility or other real property at which\n\nexpansion or redevelopment of the real property is complicated by\n\npollution;\n\n3. \"Certificate of Completion\" means a document issued by the\n\nDepartment of Environmental Quality pursuant to Section 2-15-106 of\n\nthis title upon a determination that a participant has successfully\n\ncompleted agency-approved risk-based remediation. A Certificate of\n\nCompletion is not a permit as defined in Section 2-14-103 of this\n\ntitle;\n\n4. \"Certificate of No Action Necessary\" means a document issued\n\nby the Department of Environmental Quality pursuant to Section 2-15-\n\n106 of this title upon a determination that no remediation is deemed\n\nnecessary for the expansion or redevelopment of the property for a\n\nplanned use. A Certificate of No Action Necessary is not a permit\n\nas defined in Section 2-14-103 of this title;\n\n5. \"Consent order\" means an order entered into by the\n\nDepartment of Environmental Quality and one or more participants,\n\nbinding the parties to specified authorizations, activities, duties,\n\nobligations, responsibilities and other requirements;\n\n6. \"Demonstrated pattern of uncorrected noncompliance\" means a\n\nhistory of noncompliance by the participant with state or federal\n\nenvironmental laws or rules or regulations promulgated thereto, as\n\nevidenced by past operations clearly indicating a reckless disregard\n\nfor the protection of human health and safety, or the environment;\n\n7. \"Land use disclosure\" means the Certificate of Completion or\n\nthe Certificate of No Action Necessary, issued by the Department of\n\nEnvironmental Quality, which is required to be filed in the office\n\nof the county clerk of the county wherein the site is situated\n\npursuant to Section 2-15-107 of this title. The land use disclosure\n\nshall include those items required in Section 2-7-123 of this title;\n\n8. “Pollution” means the same as the term is defined in Section\n\n2-1-102 of this title;\n\n9. \"Remediation\" means activities necessary to clean up,\n\nmitigate, correct, abate, minimize, eliminate, control and contain\n\npollution in compliance with a consent order from the Department of\n\nEnvironmental Quality;\n\n10. \"Risk-based remediation\" means site assessment or site\n\nremediation, the timing, type, and degree of which are determined\n\naccording to case-by-case consideration of actual or potential risk\n\nto human health and safety, or the environment from pollution of a\n\nbrownfield site; and\n\n11. “Site characterization” means the collection of sampling\n\nand non-sampling data to adequately delineate environmental\n\ncontamination on property and support the risk evaluation and\n\ndecision-making by the Department of Environmental Quality.","path":["OK Code","Title 27A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os27A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"f88fa165d2ab76dfd048e1f79ade733c217323c64a348973f148645611ecfe2c","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-27a-27a-2-15-102","next":"us-ok/okla.-stat.-tit.-27a-27a-2-15-104"},"notice":"GroundRules: Original legal text.
