The Department of Environmental Quality may establish and\n\nimplement a voluntary redevelopment program for brownfields. In\n\nadministering the Oklahoma Brownfields Voluntary Redevelopment Act,\n\nthe Department shall:\n\n1. Approve site-specific work plans for site characterization;\n\n2. Approve site-specific remediation plans for each site as\n\nnecessary, using a risk-based system;\n\n3. Review and inspect site characterization and remediation\n\nactivities and reports;\n\n4. Use risk-based remediation procedures as determined by the\n\nagency to establish cleanup levels;\n\n5. Evaluate engineering and institutional controls for function\n\nand performance;\n\n6. Develop and implement rules and procedures for the review\n\nand processing of Brownfields Voluntary Redevelopment project\n\napplications for obtaining funds allocated to the state from the\n\nFederal Clean Water Act and other state and federal funds available\n\nfor Brownfields Voluntary Redevelopment projects; and\n\n7. Audit completed projects to ensure compliance with use\n\nrestrictions.\n\nB. Any brownfields program established pursuant to the Oklahoma\n\nBrownfields Voluntary Redevelopment Act shall be a voluntary\n\nprogram.\n\nC. No state governmental entity regulating any person or\n\ninstitution shall require evidence of participation in the Oklahoma\n\nBrownfields Voluntary Redevelopment Act.\n\nD. The provisions of the Oklahoma Brownfields Voluntary\n\nRedevelopment Act shall not apply to any person who is:\n\n1. Responsible for taking corrective action on the real\n\nproperty pursuant to orders or agreements issued by the federal\n\nEnvironmental Protection Agency;\n\n2. Not in substantial compliance with a final agency order or\n\nany final order or judgment of a court of record secured by any\n\nstate or federal agency relating to the generation, storage,\n\ntransportation, treatment, recycling or disposal of regulated\n\nsubstances; or\n\n3. Has a demonstrated pattern of uncorrected noncompliance.\n\nE. 1. The Environmental Quality Board shall promulgate rules\n\nnecessary to implement the Oklahoma Brownfields Voluntary\n\nRedevelopment Act.\n\n2. The Department is specifically authorized to promulgate\n\nemergency rules necessary pursuant to the Administrative Procedures\n\nAct to implement the provisions of the Oklahoma Brownfields\n\nVoluntary Redevelopment Act.\n\n3.
