There are hereby re-created until July 1, 2026, pursuant to\n\nthe provisions of the Oklahoma Sunset Law:\n\n1. The Water Quality Management Advisory Council;\n\n2. The Hazardous Waste Management Advisory Council;\n\n3. The Solid Waste Management Advisory Council; and\n\n4. The Radiation Management Advisory Council.\n\nB. 1. Except as provided for in paragraph 2 of this\n\nsubsection, each Council created pursuant to subsection A of this\n\nsection shall consist of nine (9) members. Three members shall be\n\nappointed by the Governor, three members shall be appointed by the\n\nSpeaker of the House of Representatives and three members shall be\n\nappointed by the President Pro Tempore of the Senate. Appointments\n\nshall be for three-year terms. Members of the Advisory Councils\n\nshall serve at the pleasure of and may be removed from office by the\n\nappointing authority. Members shall continue to serve until their\n\nsuccessors are appointed. Any vacancy shall be filled in the same\n\nmanner as the original appointments. Five members shall constitute\n\na quorum.\n\n2. a. The Solid Waste Management Advisory Council shall\n\nconsist of ten (10) members. Four members shall be\n\nappointed by the Governor, three members shall be\n\nappointed by the Speaker of the House of\n\nRepresentatives and three members shall be appointed\n\nby the President Pro Tempore of the Senate.\n\nAppointments shall be for three-year terms. Members\n\nof the Solid Waste Management Advisory Council shall\n\nserve at the pleasure of and may be removed from\n\noffice by the appointing authority. Members shall\n\ncontinue to serve until their successors are\n\nappointed. Any vacancy shall be filled in the same\n\nmanner as the original appointments. Six members\n\nshall constitute a quorum.\n\nb. The Water Quality Management Advisory Council shall\n\nconsist of twelve (12) members. Four members shall be\n\nappointed by the Governor, four members shall be\n\nappointed by the President Pro Tempore of the Senate,\n\nand four members shall be appointed by the Speaker of\n\nthe House of Representatives. Appointments shall be\n\nfor three-year terms. Members shall serve at the\n\npleasure of and may be removed by the appointing\n\nauthority. Members may be eligible for reappointment\n\nand shall continue to serve until their successors are\n\nappointed. Vacancies shall be filled in the same\n\nmanner as their original appointments. Seven members\n\nshall constitute a quorum.\n\n3. Each Council shall elect a chair and a vice-chair from among\n\nits members. Each Council shall meet as required for rule\n\ndevelopment, review and recommendation and for such other purposes\n\nspecified by law. Special meetings may be called by the chair or by\n\nthe concurrence of any three members.\n\nC. 1. All members of the Water Quality Management Advisory\n\nCouncil shall be knowledgeable of water quality and of the\n\nenvironment. The Council shall be composed as follows:\n\na. the Governor shall appoint four members as follows:\n\n(1) one member representing the field of engineering,\n\n(2) one member representing a statewide nonprofit\n\nenvironmental organization,\n\n(3) one member representing the general public, and\n\n(4) one member representing a commercial or publicly\n\nowned laboratory accredited by the Department for\n\nboth the Drinking Water and the General\n\nEnvironmental Laboratory classifications of\n\naccreditation,\n\nb. the President Pro Tempore of the Senate shall appoint\n\nfour members as follows:\n\n(1) one member representing an industry located in\n\nthis state,\n\n(2) one member representing an oil-field-related\n\nindustry,\n\n(3) one member representing the field of geology, and\naccredited by the Department for\n\nboth the Drinking Water and the General\n\nEnvironmental Laboratory classifications of\n\naccreditation,\n\nb. the President Pro Tempore of the Senate shall appoint\n\nfour members as follows:\n\n(1) one member representing an industry located in\n\nthis state,\n\n(2) one member representing an oil-field-related\n\nindustry,\n\n(3) one member representing the field of geology, and\n\n(4) one member who holds a certificate under the\n\nWaterworks and Wastewater Works Operator\n\nCertification Act and who is the operator of a\n\nmunicipal waterworks or wastewater works\n\nfacility, and\n\nc. the Speaker of the House of Representatives shall\n\nappoint four members as follows:\n\n(1) one member representing a political subdivision\n\nof the state who shall be a member of the local\n\ngovernmental body of a city or town,\n\n(2) one member representing a rural water district\n\norganized pursuant to the laws of this state,\n\n(3) one member representing the field of agriculture,\n\nand\n\n(4) one member who holds a certificate under the\n\nWaterworks and Wastewater Works Operator\n\nCertification Act and who is the operator of a\n\nwaterworks or wastewater works for a rural water\n\nor sewer district organized pursuant to law.\n\n2. The jurisdictional areas of the Water Quality Management\n\nAdvisory Council shall include Article VI of this chapter, Article\n\nIV of this chapter, waterworks and wastewater activities, water\n\nquality and protection and related activities and such other areas\n\nas designated by the Board.\n\nD. 1. All members of the Hazardous Waste Management Advisory\n\nCouncil shall be knowledgeable of hazardous waste and of the\n\nenvironment. The Council shall be composed as follows:\n\na. the Governor shall appoint three members as follows:\n\n(1) one member representing an industry located in\n\nthis state,\n\n(2) one member representing a statewide nonprofit\n\nenvironmental organization, and\n\n(3) one member representing a political subdivision\n\nof the state who shall be a member of the local\n\ngoverning body of a city or town,\n\nb. the President Pro Tempore of the Senate shall appoint\n\nthree members as follows:\n\n(1) one member representing a political subdivision\n\nof the state who shall be a member of the local\n\ngovernmental body of a city or town,\n\n(2) one member representing the general public, and\n\n(3) one member representing industry generating\n\nhazardous waste, and\n\nc. the Speaker of the House of Representatives shall\n\nappoint three members as follows:\n\n(1) one member representing the field of engineering,\n\n(2) one member representing the hazardous waste\n\nindustry, and\n\n(3) one member representing the field of geology.\n\n2. The jurisdictional areas of the Hazardous Waste Management\n\nAdvisory Council shall include Article VII of this chapter, the\n\nOklahoma Hazardous Waste Reduction Program, and such other areas as\n\ndesignated by the Board.\n\nE. 1. All members of the Solid Waste Management Advisory\n\nCouncil shall be knowledgeable of solid waste and of the\n\nenvironment. The Council shall be composed as follows:\n\na. the Governor shall appoint four members as follows:\n\n(1) one member representing a statewide nonprofit\n\nenvironmental organization,\n\n(2) one member shall be a county commissioner,\n\n(3) one member representing the general public, and\n\n(4) one member representing the solid waste\n\nincineration, waste-to-energy industry in this\n\nstate,\n\nb. the President Pro Tempore of the Senate shall appoint\n\nthree members as follows:\n\n(1) one member representing an industry located in\n\nthis state generating solid waste,\n\n(2) one member representing a political subdivision\n\nof this state who shall be a member of the local\n\ngovernmental body of a city or town, and\n\n(3) one member representing the field of geology, and\n\nc. the Speaker of the House of Representatives shall\n\nappoint three members as follows:\nn\n\nthis state generating solid waste,\n\n(2) one member representing a political subdivision\n\nof this state who shall be a member of the local\n\ngovernmental body of a city or town, and\n\n(3) one member representing the field of geology, and\n\nc. the Speaker of the House of Representatives shall\n\nappoint three members as follows:\n\n(1) one member representing the solid waste disposal\n\nindustry in this state,\n\n(2) one member representing the field of engineering,\n\nand\n\n(3) one member representing the transportation\n\nindustry.\n\n2. The jurisdictional areas of the Solid Waste Management\n\nAdvisory Council shall include Article X of this chapter, the\n\nOklahoma Used Tire Recycling Act and such other areas as designated\n\nby the Board.\n\nF. 1. All members of the Radiation Management Advisory Council\n\nshall be knowledgeable of radiation hazards and radiation\n\nprotection. The Council shall be composed as follows:\n\na. the Governor shall appoint three members as follows:\n\n(1) one member representing an industry located in\n\nthis state which uses sources of radiation in its\n\nmanufacturing or processing business,\n\n(2) one member representing a statewide nonprofit\n\nenvironmental organization, and\n\n(3) one member representing the engineering\n\nprofession who shall be a professional engineer\n\nemployed and experienced in matters of radiation\n\nmanagement and protection,\n\nb. the President Pro Tempore of the Senate shall appoint\n\nthree members as follows:\n\n(1) one member representing the faculty of an\n\ninstitution of higher learning of university\n\nstatus and shall be experienced in matters of\n\nscientific knowledge and competent in matters of\n\nradiation management and protection,\n\n(2) one member representing the general public, and\n\n(3) one member representing the field of industrial\n\nradiography, and\n\nc. the Speaker of the House of Representatives shall\n\nappoint three members as follows:\n\n(1) one member representing the transportation\n\nindustry,\n\n(2) one member representing the petroleum industry\n\nwho is trained and experienced in radiation\n\nmanagement and protection, and\n\n(3) one member representing a medical institution\n\nwithin this state who shall be experienced in\n\nmatters of radiation management and protection.\n\n2. The jurisdictional areas of the Radiation Management\n\nAdvisory Council shall include Article IX of this chapter and such\n\nother areas as designated by the Board.\n\nG. 1. The Air Quality Council shall remain in effect as the\n\nAir Quality Advisory Council and carry on the powers and duties\n\nassigned to it by law. Future appointments to the Council shall be\n\nmade according to the provisions of this section.\n\n2. The Council shall consist of nine (9) members who shall be\n\nresidents of this state and appointed by the Governor with the\n\nadvice and consent of the Senate.\n\n3. Members of the Council shall have the qualifications as\n\nfollows:\n\na. one member shall be selected from the engineering\n\nprofession, and, as such, shall be a professional\n\nengineer and experienced in matters of air pollution\n\nequipment and control, who shall not be an employee of\n\nany unit of government,\n\nb. one member shall be selected from industry in general,\n\nand, as such, shall be employed as a manufacturing\n\nexecutive carrying on a manufacturing business within\n\nthis state,\n\nc. one member shall be selected from a faculty of an\n\ninstitution of higher learning of university status\n\nand shall be experienced in matters of scientific\n\nknowledge and competent in matters of air pollution\n\ncontrol and evaluation,\n\nd. one member shall be selected from the transportation\n\nindustry,\n\ne. one member shall be selected from the petroleum\n\nindustry, and, as such, shall be employed by a\n\npetroleum company carrying on a petroleum refining\n\nbusiness within the state, and, as such, shall be\n\ntrained and experienced in matters of scientific\nc\n\nknowledge and competent in matters of air pollution\n\ncontrol and evaluation,\n\nd. one member shall be selected from the transportation\n\nindustry,\n\ne. one member shall be selected from the petroleum\n\nindustry, and, as such, shall be employed by a\n\npetroleum company carrying on a petroleum refining\n\nbusiness within the state, and, as such, shall be\n\ntrained and experienced in matters of scientific\n\nknowledge of causes as well as effects of air\n\npollution,\n\nf. one member shall be selected from agriculture, and, as\n\nsuch, shall be engaged in or employed by a basic\n\nagricultural business or the processing of\n\nagricultural products,\n\ng. one member shall be selected from the political\n\nsubdivisions of the state, and, as such, shall be a\n\nmember of the local government body of a city or town,\n\nh. one member, whose first term shall expire on June 15,\n\n1998, shall be selected from the general public, and\n\ni. one member, whose first term shall expire on June 15,\n\n1999, shall be selected from the electric utilities\n\nindustry, and as such, shall be knowledgeable in\n\nmatters of air pollution and control.\n\n4. Each member shall be appointed to serve a term of office of\n\nseven (7) years.\n\nThe terms of all members shall be deemed to have expired on June\n\n15 of the year of expiration, and shall continue until successors\n\nhave been duly appointed and qualified. If a vacancy occurs, the\n\nGovernor shall appoint a person for the remaining portion of the\n\nunexpired term created by the vacancy. Five members of the Council\n\nshall constitute a quorum.\n\n5. The Council shall hold at least two regular meetings each\n\ncalendar year at a place and time to be fixed by the Council. The\n\nCouncil shall select one of its members to serve as chair and\n\nanother of its members to serve as vice-chair at the first regular\n\nmeeting in each calendar year to serve as the chair and vice-chair\n\nfor the ensuing year. Special meetings may be called, and any\n\nmeeting may be canceled, by the chair, or by three members of the\n\nCouncil by delivery of written notice to each member of the Council.\n\n6. The jurisdictional areas of the Air Quality Council shall\n\ninclude Article V of this chapter and such other areas as designated\n\nby the Board.\n\nH. In addition to other powers and duties assigned to each\n\nCouncil pursuant to this Code, each Council shall, within its\n\njurisdictional area:\n\n1. Have authority to recommend to the Board rules on behalf of\n\nthe Department. The Department shall not have standing to recommend\n\nto the Board permanent rules or changes to such rules within the\n\njurisdiction of a Council which have not previously been submitted\n\nto the appropriate Council for action;\n\n2. Before recommending any permanent rules to the Board, give\n\npublic notice, offer opportunity for public comment and conduct a\n\npublic rulemaking hearing when required by the Administrative\n\nProcedures Act;\n\n3. Have the authority to make written recommendations to the\n\nBoard which have been concurred upon by at least a majority of the\n\nmembership of the Council;\n\n4. Have the authority to provide a public forum for the\n\ndiscussion of issues it considers relevant to its area of\n\njurisdiction, and to:\n\na. pass nonbinding resolutions expressing the sense of\n\nthe Council, and\n\nb. make recommendations to the Board or Department\n\nconcerning the need and the desirability of conducting\n\nmeetings, workshops and seminars; and\n\n5. Cooperate with each other Council, the public, the Board and\n\nthe Executive Director in order to coordinate the rules within their\n\nrespective jurisdictional areas and to achieve maximum efficiency\n\nand effectiveness in furthering the objectives of the Department.\n\nI. The Councils shall not recommend rules for promulgation by\n\nthe Environmental Quality Board unless all applicable requirements\ncutive Director in order to coordinate the rules within their\n\nrespective jurisdictional areas and to achieve maximum efficiency\n\nand effectiveness in furthering the objectives of the Department.\n\nI. The Councils shall not recommend rules for promulgation by\n\nthe Environmental Quality Board unless all applicable requirements\n\nof the Administrative Procedures Act have been followed, including\n\nbut not limited to notice, rule impact statement and rulemaking\n\nhearings.\n\nJ. Members of the Councils shall serve without compensation but\n\nmay be reimbursed expenses incurred in the performance of their\n\nduties, as provided in the State Travel Reimbursement Act.
