It shall be the duty of the Pollution Prevention Program\n\nwithin the Department of Environmental Quality to create a\n\ncooperative partnership among the business community,\n\nmunicipalities, agencies of the state, the environmental community\n\nand the Department of Environmental Quality and all other state\n\nenvironmental agencies in which technical assistance, outreach, and\n\neducation activities are coordinated and conducted to achieve\n\npollution prevention, waste minimization and source reduction.\n\nB. The Pollution Prevention Program is hereby authorized to and\n\nmay:\n\n1. Encourage and assist facilities using toxic or hazardous\n\nsubstances to engage in comprehensive pollution prevention planning\n\nand develop measurable performance goals;\n\n2. Offer and provide technical assistance, including audits, to\n\nthe users and generators of toxic or hazardous substances; provided,\n\nhowever, the Program shall not duplicate services readily available\n\nin the private sector;\n\n3. Promote pollution prevention as the preferred means for\n\nachieving compliance with the laws of this state and shall further\n\nencourage all agencies and political subdivisions of the State of\n\nOklahoma to strongly pursue pollution prevention goals;\n\n4. Promote research in toxics use reduction in order to spur\n\npublic and private investment in pollution prevention;\n\n5. Develop and provide curriculum and training on pollution\n\nprevention for students and faculty of educational institutions,\n\nusers and generators of toxic or hazardous substances and agencies\n\nof the State of Oklahoma and its political subdivisions;\n\n6. Sponsor and conduct conferences and workshops on pollution\n\nprevention for specific classes of business or industry; and\n\n7. Compile, organize and make information available for\n\ndistribution on pollution prevention.\n\nC. The Pollution Prevention Program may develop an award and a\n\nrecognition program for the purpose of promoting pollution\n\nprevention activities among businesses and governmental entities.\n\nD. 1. The Pollution Prevention Program shall not make\n\navailable to the Department of Environmental Quality information the\n\nProgram obtains in the course of providing technical assistance to a\n\nuser or generator of toxic or hazardous waste, unless:\n\na. the user or generator agrees that such information may\n\nbe available to the Department,\n\nb. the information is public record information,\n\nc. the information pertains to an imminent threat to\n\npublic health or safety, or to the environment, or\n\nd. disclosure to the Department is required by law.\n\n2. The Program shall notify users or generators requesting\n\ntechnical assistance of these provisions.\n\n3. Any technical assistance or information obtained by the\n\nProgram shall not result in any regulatory inspections or other\n\nenforcement actions unless there is a reasonable cause to believe\n\nthere exists a clear and imminent threat to the public health or\n\nsafety or to the environment.\n\nE.
