Stat. tit. 27A, § 27A-2-3-109","heading":"Oklahoma Energy Efficiency and Emission Reduction","body":"Program.\n\nA. There is hereby created the “Oklahoma Energy Efficiency and\n\nEmission Reduction Program”, to be administered by the Department of\n\nEnvironmental Quality. The purpose of the Oklahoma Energy\n\nEfficiency and Emission Reduction Program is to fund activities and\n\nprojects designed to reduce regional air pollution.\n\nB. The Oklahoma Legislature finds that any activity or project\n\nthat reduces regional air pollution is desirable and advantageous\n\nand serves a compelling public interest. Further, improved air\n\nquality enhances the health and quality of life for the citizens of\n\nOklahoma, helps maintain the abundant natural beauty and resources\n\nof the state, and fosters the economic well-being of the state by\n\nreducing the potential that the federal government will designate\n\nsome or all of the state as in air-quality “nonattainment” status,\n\nresulting in extremely burdensome additional regulatory\n\nrequirements.\n\nC. 1. Any funds made available for the Oklahoma Energy\n\nEfficiency and Emission Reduction Program shall be used by the\n\nDepartment for matching grants to governmental and nongovernmental\n\nentities in Oklahoma to encourage the implementation of recognized\n\nair pollution reduction measures, including, but not limited to, the\n\nretrofitting of truck and bus fleets or locomotives to use cleaner\n\nfuels and the installation and implementation of energy efficiency\n\nmeasures.\n\n2. Grants awarded under the Program shall be limited to ninety-\n\nfive percent (95%) of the direct project costs in the case of\n\ngovernmental entities and seventy-five percent (75%) of the direct\n\nproject costs in the case of nongovernmental entities.\n\n3. In making grant awards, the Department shall enter into a\n\ncontract or memorandum of agreement with the grantee that includes\n\nconditions and safeguards to ensure that the matching funds are\n\nexpended for the purposes specified and that the state receives a\n\nclear benefit from the expenditure. In addition to any other\n\nconditions and safeguards deemed necessary and appropriate:\n\na. the Department shall require grant recipients to\n\nsubmit a report within a reasonable time after\n\nconstruction, installation, or implementation of the\n\nproject that summarizes the results, including\n\nemissions reductions achieved and “lessons learned”.\n\nInformation from the reports may be used by the\n\nDepartment in evaluation of future grant applications\n\nor proposals for the Oklahoma Energy Efficiency and\n\nEmission Reduction Program or any similar grant\n\nprogram and to determine the viability of other\n\nprojects or programs that may be proposed to control\n\nor reduce air pollution in the state, and\n\nb. to secure the maximum possible benefit by increasing\n\nawareness of the Oklahoma Energy Efficiency and\n\nEmission Reduction Program, the Department may require\n\nany grant recipient to post notice in a conspicuous\n\nplace of participation in the Program and the nature\n\nof the funded project.\n\n4. Before making any grants, the Department shall determine to\n\nits satisfaction that the proposed project will significantly reduce\n\nair pollution within the state. The Department is authorized to set\n\na deadline for grant applications, and if the total grant funding\n\nsought exceeds the amount available under the Program, the\n\nDepartment shall give priority to those projects that appear to\n\nachieve the maximum public health benefit for citizens of the state.\n\n5. Not more than twenty-five percent (25%) of the total sum\n\navailable for grants under the Program shall be awarded to any\n\nsingle entity. Application of this limit shall not preclude\n\nparticipation by the recipient in any similar grant program in the\n\nfuture.\n\nD. If funds are appropriated by the Legislature for the\n\nOklahoma Energy Efficiency and Emission Reduction Program, not more\nthe state.\n\n5. Application of this limit shall not preclude\n\nparticipation by the recipient in any similar grant program in the\n\nfuture.\n\nD. If funds are appropriated by the Legislature for the\n\nOklahoma Energy Efficiency and Emission Reduction Program, not more\n\nthan One Hundred Thousand Dollars ($100,000.00) annually of the\n\nfunds shall be used by the Department for personnel and other costs\n\nassociated with administration and management of the Program, and\n\nfor providing technical assistance to entities applying for and\n\nparticipating in the Program.\n\nE. On or before September 1, 2009, and by September 1 each year\n\nthereafter, the Department shall submit to the Governor, the Speaker\n\nof the House of Representatives, and the President Pro Tempore of\n\nthe Senate a report on the Oklahoma Energy Efficiency and Emission\n\nReduction Program.
