The Environmental Quality Board shall appoint the Executive\n\nDirector of the Department of Environmental Quality. The Executive\n\nDirector shall serve at the pleasure of the Board.\n\nB. The Executive Director shall have experience in industry,\n\nconservation, environmental sciences or such other areas as may be\n\nrequired by the Environmental Quality Board.\n\nC. The Executive Director shall provide for the administration\n\nof the Department and shall:\n\n1. Be the executive officer and supervise the activities of the\n\nDepartment of Environmental Quality;\n\n2. Employ, discharge, appoint or contract with, and fix the\n\nduties and compensation of such assistants, attorneys, chemists,\n\ngeologists, environmental professionals, medical professionals,\n\nengineers, sanitarians, administrative, clerical and technical,\n\ninvestigators, aides and such other personnel, either on a full-\n\ntime, part-time, fee or contractual basis, as in his judgment and\n\ndiscretion shall be deemed necessary, expedient, convenient or\n\nappropriate to the performance or carrying out of any of the\n\npurposes, objectives, responsibilities or statutory provisions\n\nrelating to the Department of Environmental Quality, or to assist\n\nthe Executive Director in the performance of his official duties and\n\nfunctions;\n\n3. Establish internal policies and procedures for the proper\n\nand efficient administration of the Department; and\n\n4. Exercise all incidental powers which are necessary and\n\nproper to implement the purposes of the Department pursuant to this\n\nCode.\n\nD. The Executive Director shall not be an owner, stockholder,\n\nemployee or officer of, nor have any other business relationship\n\nwith or receive compensation from, any corporation, partnership, or\n\nother business or entity which is subject to regulation by the\n\nDepartment of Environmental Quality and, with regard to the exercise\n\nof powers and duties associated with the Oklahoma Pollutant\n\nDischarge Elimination System Act, shall meet all requirements of\n\nSection 304 of the Clean Water Act and applicable federal\n\nregulations promulgated thereunder by the United States\n\nEnvironmental Protection Agency regarding conflict of interest.\n\nE. 1. In addition to the powers and duties specified in\n\nsubsection D of this section, the Executive Director shall have the\n\npower and duty to:\n\na. issue, deny, modify, amend, renew, refuse to renew,\n\nsuspend, reinstate or revoke licenses or permits\n\npursuant to the provisions of this Code, and rules\n\npromulgated by the Board, and\n\nb. issue final orders and assess administrative penalties\n\naccording to the Administrative Procedures Act, this\n\nCode and rules promulgated by the Board.\n\n2. The powers and duties specified in paragraph 1 of this\n\nsubsection shall be exercised exclusively by the Executive Director\n\nand may not be delegated to other employees of the Department except\n\nas specifically provided in this Code.\n\n3. In the event of the Executive Director's temporary absence,\n\nthe Executive Director may delegate the exercise of such powers and\n\nduties to an acting director during the Executive Director's absence\n\nsubject to an organizational structure approved by the Board. In\n\nthe event of a vacancy in the position of Executive Director, the\n\nBoard may designate an interim or acting Executive Director who is\n\nauthorized to exercise such powers and duties until a permanent\n\nExecutive Director is employed.\n\n4. Any designee exercising such powers and duties of the\n\nExecutive Director as authorized or on a temporary, acting or\n\ninterim basis shall meet the requirements of subsection D of this\n\nsection for the Executive Director.\n\n5. All references in this Code to the Department with respect\n\nto the exercise of the powers and duties specified in paragraph 1 of\npermanent\n\nExecutive Director is employed.\n\n4. Any designee exercising such powers and duties of the\n\nExecutive Director as authorized or on a temporary, acting or\n\ninterim basis shall meet the requirements of subsection D of this\n\nsection for the Executive Director.\n\n5.
