Within its jurisdictional areas of responsibility, the\n\nDepartment, acting through the Executive Director, or persons\n\nauthorized by law, rule or designated by the Executive Director to\n\nperform such acts, shall have the power and duty to:\n\n1. Access any premises at any reasonable time upon presentation\n\nof identification for purposes of administering this Code, and the\n\nright to apply to and obtain from a judge of the district court, an\n\nadministrative or other warrant as necessary to enforce such access;\n\n2. Determine and assess administrative penalties, take or\n\nrequest civil action, request criminal prosecution or take other\n\nadministrative or civil action as specifically authorized by this\n\nCode or other law against any person or entity who has violated any\n\nof the provisions of this Code, rules promulgated thereunder, or any\n\npermit, license or order issued pursuant thereto;\n\n3. Investigate or cause to be investigated alleged violations\n\nof this Code, rules promulgated thereunder, or permits, licenses or\n\norders issued pursuant thereto;\n\n4. Conduct investigations, inquiries and inspections, including\n\nbut not limited to, the review of records and the collection of\n\nsamples for laboratory analyses;\n\n5. Conduct hearings and issue subpoenas according to the\n\nAdministrative Procedures Act, this Code and rules promulgated by\n\nthe Board, and file contempt proceedings against any person\n\ndisobeying or refusing to comply with such subpoena;\n\n6. Advise, consult, cooperate and enter into agreements with\n\nagencies of the state, municipalities and counties, industries,\n\nother states and the federal government, and other persons;\n\n7. Enter into agreements for, accept, administer and use,\n\ndisburse and administer grants of money, personnel and property from\n\nthe federal government or any department or agency thereof, or from\n\nany state or state agency, or from any other source, to promote and\n\ncarry on in this state any program relating to environmental\n\nservices or pollution control;\n\n8. Require the establishment and maintenance of records and\n\nreports, and the installation, use, and maintenance of monitoring\n\nequipment or methods, and the provision of such information to the\n\nDepartment upon request;\n\n9. Establish a system of training for all personnel who render\n\nreview and inspection services in order to assure uniform statewide\n\napplication of law and rules;\n\n10. Enforce the provisions of this Code and rules promulgated\n\nthereunder and orders, permits and licenses issued pursuant thereto;\n\n11. Charge and receive fees pursuant to fee schedules\n\npromulgated by the Board;\n\n12. Register persons, property and activities as required by\n\nthis Code or rules promulgated by the Board;\n\n13. Conduct studies, research and planning of programs and\n\nfunctions, pursuant to the authority granted by this Code;\n\n14. Collect and disseminate information and engage in\n\nenvironmental education activities relating to the provisions of\n\nthis Code;\n\n15. Provide a toll-free hot line for environmental complaints;\n\n16. Enter into interagency agreements;\n\n17. Sell films, educational materials and other items produced\n\nby the Department and sell, exchange or otherwise dispose of\n\nobsolete personal property belonging to the Department unless\n\notherwise required by terms of federal grants;\n\n18. Provide administrative and support services to the Board\n\nand the Councils as necessary to assist them in the performance of\n\ntheir duties; and\n\n19. Exercise all incidental powers which are necessary and\n\nproper to implement and administer the purposes of this Code.\n\nB.
