The Board shall establish schedules of fees to be charged\n\nfor applications for, or the issuance of, new, modified or renewed\n\npermits, licenses, certificates and other authorizations and for\n\nsuch other environmental services as are involved in the regulation\n\nof environmental functions and programs authorized by the provisions\n\nof this Code. Such fees shall be subject to the following\n\nlimitations:\n\n1. The Board shall follow the procedures required by the\n\nAdministrative Procedures Act for promulgation of rules in\n\nestablishing or amending any such schedule of fees;\n\n2. The Board shall base its schedule of fees for each\n\nenvironmental function or program upon the reasonable costs of\n\noperating such environmental functions or programs, including, but\n\nnot limited to, the costs of administration, personnel, office\n\nspace, equipment, training, travel, inspection and review rendered\n\nin connection with each such function or program;\n\n3. The Board shall promulgate rules establishing fee schedules\n\nfor services, functions and programs within the advisory\n\njurisdiction of a Council created by this Code only upon receipt of\n\nfee schedule recommendations from such Council;\n\n4. Any facility exempt from the requirement to obtain a permit\n\nbased on date of construction or start-up may be assessed an annual\n\npermit renewal fee equivalent; and\n\n5. The Department shall expend monies received from permit,\n\nlicense and certification programs, including but not limited to\n\napplication, review, inspection, monitoring and operating fees, only\n\non the direct or indirect costs of the specific programs from which\n\nsuch monies originate.\n\nB. The Board shall establish a schedule of fees to be charged\n\nfor services including, but not limited to, searches, compilations,\n\ncertifications or reproduction of maps and publications,\n\ntranscripts, blueprints, computer data, electronic recordings or\n\ndocuments. Such fees shall be based on the actual cost to the\n\nDepartment for the provision of such services.\n\nC. The Board shall promulgate a schedule of fees for the\n\nprovision of services to validate reports from facilities required\n\nto report, but not merely to notify, under the Oklahoma Hazardous\n\nMaterials Planning and Notification Act.\n\nD.
