The Department of Environmental Quality is authorized to\n\nacquire, operate and maintain laboratories to analyze samples to:\n\n1. Obtain factual data to support any order, permit, function\n\nor program of the Department;\n\n2. Provide laboratory service for individuals, cities, towns,\n\ncounties, tribes, state institutions and other state and federal\n\nagencies; and\n\n3. Provide such services and perform such other analyses as is\n\nnecessary to implement and enforce the programs and functions under\n\nthe jurisdiction of the Department pursuant to this Code.\n\nB. The Board of Environmental Quality shall promulgate rules\n\nfor laboratory services under this Code. The Board shall follow the\n\nprocedures required by the Administrative Procedures Act for\n\npromulgation of such rules.\n\nC. 1. The Board, pursuant to the Administrative Procedures\n\nAct, shall promulgate as a rule a fee schedule based on actual cost\n\nof analyses and the costs of the provision of laboratory services.\n\nThe schedule shall include fees for specific analytes and\n\nprocedures.\n\n2. Fees charged pursuant to this section shall be paid into the\n\nDepartment of Environmental Quality Revolving Fund and shall only be\n\nused by the Department in administering the Department's\n\nenvironmental laboratory.\n\nD.
