The Department of Environmental Quality shall mutually\n\nrecognize environmental laboratory accreditations issued by The\n\nNELAC Institute’s (TNI) primary National Environmental Laboratory\n\nAccreditation Program (NELAP) accreditation bodies without any\n\nduplicative actions to determine the laboratory’s conformity to TNI\n\nStandards. These actions include, but are not limited to,\n\nproficiency testing, quality assurance, and on-site assessment.\n\nB. Mutual recognition does not mean automatic accreditation by\n\nthe Department or exemption from complying with the Department’s\n\nadministrative processes.\n\nC. Mutual recognition does not prevent the Department from\n\nverifying the accreditation with the primary accreditation body or\n\nrequiring a laboratory to adhere to applicable laws, rules and\n\nnormal administrative processes, such as submitting applications and\n\npaying fees, so long as the Department does not impose additional\n\nrequirements concerning proficiency testing, quality assurance, on-\n\nsite assessment or other matters relating to conformance to TNI\n\nStandards.\n\nD. Mutual recognition is limited to the fields of accreditation\n\nincluded in the primary accreditation consistent with the scope of\n\nthe Department’s laboratory accreditation program. If a laboratory\n\ndoes not hold a primary accreditation in categories requested of the\n\nDepartment, the laboratory must apply for primary accreditation for\n\nthose categories in Oklahoma.\n\nE. The Department is not required to recognize a primary\n\naccreditation or grant secondary accreditation if a law, rule,\n\nadministrative proceeding or court order precludes or has the effect\n\nof precluding the Department from granting accreditation in whole or\n\nin part to a laboratory.\n\nF.
