Nothing in the Oklahoma Clean Air Act:\n\na. shall prevent cities, towns and counties from enacting\n\nordinances or codes with respect to air pollution\n\nwhich will not conflict with the provisions of the\n\nOklahoma Clean Air Act and which contain provisions\n\nmore stringent than those fixed by the operation of\n\nthe Oklahoma Clean Air Act; provided, however, that\n\nany city or town which has a population of less than\n\nthree hundred thousand (300,000) persons according to\n\nthe most current census shall not enforce any\n\nordinance or code regarding air pollution containing\n\nmore stringent provisions unless and until such\n\nordinance or code is reviewed by the Council and\n\napproved as to its reasonableness and technical\n\nfeasibility.\n\nb. shall prevent cities and towns from summarily abating\n\npublic nuisances as now provided by law.\n\n2. This subsection shall not apply to any air pollution\n\nordinances or codes enacted by cities, towns or counties and in\n\neffect prior to May 15, 1992.\n\nB. Except for authority regarding abatement of public\n\nnuisances, no city, town, municipality, county or other political\n\nsubdivision shall enact or enforce any code, ordinance or rule which\n\nis more stringent than, or which is in conflict with any state or\n\nfederal law, code or rule concerning the utilization of fuel in any\n\nflange-wheeled railroad rolling stock or which attempts to regulate\n\nor affect the emissions therefrom.\n\nC.
