Stat. tit. 27A, § 27A-2-5-104","heading":"Definitions","body":"As used in the Oklahoma Clean Air Act:\n\n1. \"Accidental release\" means an unanticipated emission of a\n\nregulated substance or other extremely hazardous substance into the\n\nambient air from a stationary source;\n\n2. \"Air contaminants\" means the presence in the outdoor\n\natmosphere of fumes, aerosol, mist, gas, smoke, vapor, particulate\n\nmatter or any combination thereof which creates a condition of air\n\npollution;\n\n3. \"Air pollution\" means the presence in the outdoor atmosphere\n\nof one or more air contaminants in sufficient quantities and of such\n\ncharacteristics and duration as tend to be or may be injurious to\n\nhuman, plant or animal life or to property, or which interfere with\n\nthe comfortable enjoyment of life and property, excluding, however,\n\nall conditions pertaining to employer-employee relations;\n\n4. \"Ambient air\" means the surrounding outdoor air;\n\n5. \"Chair\" means the Chair of the Air Quality Council;\n\n6. \"Council\" means the Air Quality Council;\n\n7. \"Director\" means the Director of Air Quality Division;\n\n8. \"Emission\" means the release or discharge of any air\n\ncontaminant or potential air contaminant into the ambient air;\n\n9. \"Federal Clean Air Act\" means the Federal Clean Air Act, 42\n\nU.S.C. 7401, et seq., as amended, including the Federal Clean Air\n\nAct Amendments of 1990;\n\n10. \"Hazardous air pollutant\" means any air pollutant listed\n\nand regulated pursuant to subsection (b) of Section 112 of the\n\nFederal Clean Air Act;\n\n11. \"Hearing officer\" means a person appointed to preside at\n\npublic hearings held pursuant to this article;\n\n12. \"Panel\" means the Compliance Advisory Panel;\n\n13. \"Person\" means any individual, partnership, copartnership,\n\nfirm, company, corporation, association, joint stock company, trust,\n\nestate, municipality or any other legal entity, or their\n\nrepresentative, agent or assign;\n\n14. \"Regulated substance\" means any substance, including\n\nextremely hazardous substances, listed and regulated pursuant to\n\nSection 112(r)(3) of the Federal Clean Air Act;\n\n15. \"Small Business Stationary Source\" means a stationary\n\nsource as defined in Section 507 (c) of the Federal Clean Air Act;\n\n16. \"Toxic air contaminant\" means any substance determined to\n\nbe highly toxic, moderately toxic, or of low toxicity pursuant to\n\ncriteria set forth by rule. The term shall not be construed to\n\ninclude pollutants for which a primary and secondary ambient air\n\nquality standard has been promulgated under the Federal Clean Air\n\nAct to the extent of the criteria for which they are listed; and\n\n17. \"Trade secret\" means information, including but not limited\n\nto a formula, pattern, compilation, program, device, method,\n\ntechnique or process, that:\n\na. derives independent economic value, actual or\n\npotential, from not being generally known to, and not\n\nbeing readily ascertainable by proper means by, other\n\npersons who can obtain economic value from its\n\ndisclosure or use, and\n\nb. is the subject of efforts that are reasonable under\n\nthe circumstances to maintain its secrecy.\n\nThe term \"trade secret\" shall not be construed to include data\n\nconcerning the amount, emission rate or identification of any air\n\ncontaminant emitted by any source, nor shall it include the contents\n\nof any proposed or final permit.","path":["OK Code","Title 27A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os27A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"db938b1f7ff4cde4c5f6066a0aabb3d8d58c275ea1c41cc6be038856b0b228ac","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-27a-27a-2-5-103","next":"us-ok/okla.-stat.-tit.-27a-27a-2-5-105"},"notice":"GroundRules: Original legal text.
