For purposes of this section, “open burning” means the\n\nburning of combustible materials in such a manner that the products\n\nof combustion are emitted directly to the outside atmosphere.\n\nB. A municipal fire department may engage in controlled open\n\nburning of a structure for purposes of fire training if the records\n\nof the department document the purpose of the open burn and the\n\nfollowing conditions are met:\n\n1. The municipal fire chief or designee shall provide\n\nnotification of the planned open burn to the Department of\n\nEnvironmental Quality at least ten (10) days prior to the burning.\n\nThe notification shall be on a form developed by the Department,\n\ndocument that the provisions of this section are satisfied and be\n\nsigned by the municipal fire chief;\n\n2. For any human-made structure, the entire structure,\n\nincluding, but not limited to, insulation, roofing, flooring,\n\npainted surfaces and plumbing, shall be examined for the presence of\n\nasphalt, asbestos and lead-containing materials. All asphalt,\n\nasbestos and lead-containing materials shall be removed from the\n\nstructure prior to the fire training. Asbestos inspection and\n\nremoval shall be conducted according to the requirements of federal\n\nlaw;\n\n3. Any human-made structure demolished pursuant to the\n\nprovisions of this act shall not be demolished prior to the fire\n\ntraining. Demolition shall not include structural deterioration due\n\nto natural causes;\n\n4. Prior to conducting any fire training involving a human-made\n\nstructure located within three hundred (300) feet of another human-\n\nmade structure, the municipality shall notify in writing the owners\n\nof the property located within three hundred (300) feet within ten\n\n(10) days prior to a meeting of the governing body of the\n\nmunicipality to provide an opportunity for public comment; and\n\n5. Following the completion of fire training, all debris\n\nresulting from the training must be disposed of in the appropriate\n\nmanner.\n\nC.
