Stat. tit. 27A, § 27A-2-5-114","heading":"Implementation and enforcement of federal emission","body":"standards - Oil and gas well and equipment emissions.\n\nA. The Department shall have the authority to establish a\n\nprogram for the implementation and enforcement of the federal\n\nemission standards and other requirements under Section 112 of the\n\nFederal Clean Air Act for hazardous air pollutants and for the\n\nprevention and mitigation of accidental releases of regulated\n\nsubstances under Section 112(r) of the Federal Clean Air Act.\n\n1. Except as otherwise provided by paragraph 2 of this\n\nsubsection, to assure that such program shall be consistent with,\n\nand not more stringent than, federal requirements:\n\na. any rule recommended by the Council and promulgated by\n\nthe Board regarding hazardous air pollutants and\n\nregulated substances shall only be by adoption by\n\nreference of final federal rules, and\n\nb. shall include the federal early reduction program\n\nunder Section 112(i) (5) of the Federal Clean Air Act.\n\n2. The Board may promulgate, pursuant to recommendation by the\n\nCouncil, rules which establish emission limitations for hazardous\n\nair pollutants which are more stringent than the applicable federal\n\nstandards, upon a determination by the Council that more stringent\n\nstandards are necessary to protect the public health or the\n\nenvironment.\n\nB. The Department shall also have the authority to establish a\n\nseparate and distinct program only for the control of the emission\n\nof those toxic air contaminants not otherwise regulated by a final\n\nemission standard under Section 112(d) of the Federal Clean Air Act.\n\n1. Such program shall consist of permanent rules establishing:\n\na. appropriate emission limitations, work practice\n\nstandards, maximum acceptable ambient concentrations\n\nor control technology standards necessary for the\n\nprotection of the public health or the environment,\n\nand\n\nb. emissions monitoring or process monitoring\n\nrequirements necessary to assure compliance with the\n\nrequirements of this section.\n\n2. Paragraph 1 of this subsection shall not be construed as\n\nrequiring readoption of existing rules regarding toxic air\n\ncontaminants.\n\nC. Regulation of any hazardous air pollutant pursuant to a\n\nfinal emission standard promulgated under Section 112(d) of the\n\nFederal Clean Air Act, shall preclude its regulation as a toxic air\n\ncontaminant under subsection B of this section.\n\nD. Emissions from any oil or gas exploration or production well\n\nwith its associated equipment, and emissions from any pipeline\n\ncompressor or pump station shall not be aggregated with emissions\n\nfrom other similar units, whether or not such units are in a\n\ncontiguous area or under common control, to determine whether such\n\nunits or stations are major sources, and in the case of any oil or\n\ngas exploration or production well with its associated equipment,\n\nsuch emissions shall not be aggregated for any purpose under this\n\nsection.\n\nE. The Department shall not list oil and gas production wells\n\nwith their associated equipment as an area source category, except\n\nthat the Department may establish an area source category for oil\n\nand gas production wells located in any metropolitan statistical\n\narea or consolidated metropolitan statistical area with a population\n\nin excess of one million (1,000,000) if the Department determines\n\nthat emissions of hazardous air pollutants from such wells present\n\nmore than a negligible risk of adverse effects to public health.\n\nF.
