Any person who knowingly and willfully:\n\n1. Violates any applicable provision of the Oklahoma Clean Air\n\nAct or any rule or standard promulgated thereunder;\n\n2. Violates any order issued or permit condition prescribed\n\npursuant to the Oklahoma Clean Air Act;\n\n3. Violates any emission limitation or any substantive\n\nprovision or condition of any permit;\n\n4. Makes any false material statement, representation, or\n\ncertification in, or omits material information from, or knowingly\n\nalters, conceals, or fails to file or maintain any notice,\n\napplication, record, report, plan or other document, except for\n\nmonitoring data, required pursuant to the Oklahoma Clean Air Act to\n\nbe either filed or maintained;\n\n5. Fails to notify or report as required by the Oklahoma Clean\n\nAir Act, rules promulgated thereunder or orders or permits issued\n\npursuant thereto; or\n\n6. Fails to install any monitoring device or method required to\n\nbe maintained or followed pursuant to the Oklahoma Clean Air Act;\n\nshall, upon conviction, be guilty of a misdemeanor and be punished\n\nby a fine not to exceed Twenty-five Thousand Dollars ($25,000.00)\n\nper day of violation or for not more than one (1) year imprisonment\n\nin the county jail, or both such fine and imprisonment.\n\nB. Any person who knowingly and willfully:\n\n1. Violates any applicable provision of the Oklahoma Clean Air\n\nAct or any rule promulgated thereunder, or any order of the\n\nDepartment or any emission limitation or substantive provision or\n\ncondition of any permit, and who knows at the time that he thereby\n\nplaces another in danger of death or serious bodily injury;\n\n2. Tampers with or renders inaccurate any monitoring device; or\n\n3.
