The Department shall have the authority to commence a civil\n\naction for a permanent or temporary injunction or other appropriate\n\nrelief, or to require abatement of any emission or correction of any\n\ncontamination, or to seek and recover a civil penalty of not more\n\nthan Ten Thousand Dollars ($10,000.00) per day for each violation,\n\nor all of the above, in any of the following instances:\n\n1. Whenever any person has violated or is in violation of any\n\napplicable provision of the Oklahoma Clean Air Act, or any rule\n\npromulgated thereunder;\n\n2. Whenever any person has commenced construction, modification\n\nor operation of any source, or operates any source in violation of\n\nthe requirement to have a permit, or violates or is in violation of\n\nany substantive provision or condition of any permit issued pursuant\n\nto the Oklahoma Clean Air Act; or\n\n3. Whenever any person has violated any order of the Department\n\nor the Council or any requirement to pay any fee, fine or penalty\n\nowed to the state pursuant to the Oklahoma Clean Air Act.\n\nB. The district attorney or attorneys having jurisdiction shall\n\nhave primary authority and responsibility for prosecution of any\n\ncivil or criminal violations under the Oklahoma Clean Air Act and\n\nfor the collection of any delinquent fees, penalties or fines\n\nassessed pursuant to the Oklahoma Clean Air Act and shall be\n\nentitled to recover reasonable costs of collection, including\n\nattorney fees, and an appropriate fee of up to fifty percent (50%)\n\nfor collecting delinquent fees, penalties or fines.","path":["OK Code","Title 27A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os27A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"29f36558af5dc948a4091b4da5f6f4b963cf950546887063e833cb11eb667d99","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-27a-27a-2-5-116","next":"us-ok/okla.-stat.-tit.-27a-27a-2-5-130"},"notice":"GroundRules: Original legal text.
