The Department of Environmental Quality shall not\n\nrequire the use of an air curtain incinerator for fires purposely\n\nset for land clearing operations except in counties or areas within\n\na county that:\n\na. are or have been designated nonattainment for National\n\nAmbient Air Quality Standards (NAAQS) or where the\n\nDepartment-certified ambient air quality monitoring\n\ndata documents a violation of primary NAAQS prior to\n\nsuch determination, or\n\nb. have a population of greater than five hundred\n\nthousand (500,000) people according to the latest\n\nFederal Decennial Census.\n\n2. For the purposes of this section, \"air curtain incinerator\"\n\nmeans an incineration unit, operating by forcefully projecting a\n\ncurtain of air across an open integrated combustion chamber or open\n\npit or trench, in which combustion occurs.\n\nB. The Department shall not require the use of an air curtain\n\nincinerator for fires purposely set for the burning of clean wood\n\nwaste or yard brush except in counties or areas within a county\n\nthat:\n\n1. Are or have been designated nonattainment for National\n\nAmbient Air Quality Standards (NAAQS) or where the Department-\n\ncertified ambient air quality monitoring data documents a violation\n\nof primary NAAQS prior to such determination; or\n\n2. Have a population of greater than five hundred thousand\n\n(500,000) people according to the latest Federal Decennial Census.\n\nC. The Department may promulgate rules to limit accumulation of\n\nclean wood waste or yard brush.\n\nD. The burning of clean wood waste or yard brush shall not\n\ncreate a public nuisance.\n\nE.
