The Department of Environmental Quality shall not require a\n\npermit for applying less than two hundred fifty (250) gallons per\n\nday of private residential gray water originating from a residence\n\nfor the household gardening, composting or landscape irrigation of\n\nthe resident if:\n\n1. A constructed gray water distribution system provides for\n\noverflow into the sewer system or on-site wastewater treatment and\n\ndisposal system;\n\n2. A gray water storage tank is covered to restrict access and\n\nto eliminate habitat for mosquitoes or other vectors;\n\n3. A gray water system is sited outside of a floodway;\n\n4. Gray water is vertically separated at least five (5) feet\n\nabove the groundwater table;\n\n5. Gray water pressure piping is clearly identified as a\n\nnonpotable water conduit;\n\n6. Gray water is used on the site where it is generated and\n\ndoes not run off the property lines;\n\n7. Gray water is applied in a manner that minimizes the\n\npotential for contact with people or domestic pets;\n\n8. Ponding is prohibited, application of gray water is managed\n\nto minimize standing water on the surface and to ensure that the\n\nhydraulic capacity of the soil is not exceeded;\n\n9. Gray water is not sprayed;\n\n10. Gray water is not discharged to a waterway;\n\n11. Gray water use within municipalities or counties complies\n\nwith all applicable municipal or county ordinances enacted pursuant\n\nto law; and\n\n12. A gray water storage system which complies with the\n\nprovisions of this section may allow for rainwater to be introduced\n\ninto the system.\n\nB.
