Except as otherwise provided in subsection B of this\n\nsection, it shall be unlawful for any facility, activity or entity\n\nregulated by the Department of Environmental Quality pursuant to the\n\nOklahoma Pollutant Discharge Elimination System Act to discharge any\n\npollutant into waters of the state or elsewhere without first\n\nobtaining a permit from the Executive Director.\n\nB. The Environmental Quality Board shall promulgate rules which\n\nprescribe permit requirements applicable to discharges composed\n\nentirely of stormwater. The rules may require permits on a case-by-\n\ncase basis, exempt categories of discharges, or provide a schedule\n\nfor obtaining a permit. No later than the date that the Department\n\nis to receive authorization to administer a state National Pollutant\n\nDischarge Elimination Systems program, the Board shall have\n\npromulgated rules for stormwater discharges which comply with\n\nEnvironmental Protection Agency requirements for approval of the\n\nstate National Pollutant Discharge Elimination Systems program.\n\nC. The Department of Environmental Quality shall have the\n\nauthority to determine whether a facility, activity or entity\n\nregulated by the Department pursuant to the Oklahoma Pollutant\n\nDischarge Elimination System Act is required to obtain a stormwater\n\npermit. No other state agency shall condition any license, permit\n\nor other form of authorization issued by that agency upon the\n\napplicant obtaining a stormwater permit from the Department if the\n\napplicant is not required to obtain a stormwater permit pursuant to\n\nDepartment statutes and rules promulgated by the Board.","path":["OK Code","Title 27A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os27A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"ed0c6272ffdd98277f5562cf32009ce46e5650ba974cf8b0f5bff23f82c6a49d","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-27a-27a-2-6-204","next":"us-ok/okla.-stat.-tit.-27a-27a-2-6-206"},"notice":"GroundRules: Original legal text.
