Except as otherwise provided for in this section, no person\n\nshall supply water, or do any construction work of any nature for\n\nsupplying water, to the public from or by a public water supply\n\nsystem by means of any waterworks without a written permit to\n\nconstruct issued by the Executive Director of the Department of\n\nEnvironmental Quality.\n\nB. 1. The Department of Environmental Quality may grant an\n\nexception to a public water supply system from the review and permit\n\nrequirement for construction of a water line extension.\n\n2. The Board shall promulgate rules setting forth conditions\n\nfor the exceptions including but not limited to a certification by\n\nthe system, upon application for an exception, that the proposed\n\ndesign and construction of the extension meets or exceeds Board\n\nstandards and, after the completion of construction but prior to the\n\ncommencement of service by the extension, a sufficiency\n\ncertification by a professional engineer licensed to practice in the\n\nState of Oklahoma, that the extension as constructed meets or\n\nexceeds Board standards. The certifications shall provide\n\nassurances, respectively, that the integrity and capacity of the\n\nexisting system will not or have not been compromised. The rules\n\nshall allow a rural water district or nonprofit rural water\n\ncorporation to submit in lieu of a sufficiency certification by a\n\nprofessional engineer, certification by a certified waterworks\n\noperator employed by the district, provided that the line extension\n\nis not larger than the existing line, that no part of the existing\n\nwater line was previously extended pursuant to this paragraph, that\n\nthe extension does not add more than one (1) service connection to\n\nthe existing line, and that the line has not been extended through,\n\nover or under any stream, lake, pond or marsh or any existing sewage\n\nor wastewater collection lines.\n\n3. The Department may disallow any exception application which\n\ndoes not comply with this section or rules promulgated by the Board,\n\nor which does not assure protection of the existing system or public\n\nhealth and the environment.\n\n4. Failure of a system to meet the terms of a granted exception\n\nmay result in the termination of the exception, the denial of future\n\nexceptions or the imposition of permit or corrective action\n\nrequirements by the Department, or a combination thereof. No\n\nexception shall be terminated until the Department has advised the\n\nowner or operator of the excepted system and are given an\n\nopportunity to show compliance with all exception requirements.\n\nC. An application for a permit to construct shall be\n\naccompanied by maps, plans and specifications, prepared by a\n\nprofessional engineer registered in the State of Oklahoma. The\n\napplication shall include but not be limited to:\n\n1. A description of the design of the system;\n\n2. Identification of the system's source;\n\n3. A description of the manner of storage and distribution and\n\npurification of the water proposed for the supply previous to its\n\ndelivery to consumers; and\n\n4. Any other data and information required by the Department.\n\nD. Any person serving water to the public from a system that\n\nwas constructed without a permit to construct and was being used to\n\nserve water to the public prior to June 1, 2011, may meet the\n\nrequirements of subsection A of this section by obtaining a permit\n\nto supply issued by the Executive Director. Applications for the\n\npermits shall be accepted only if they are complete. The Department\n\nmay deny any application that fails to establish that the water\n\nsupply meets and can continue to meet the drinking water standards.\n\nIn order to be considered complete, applications shall include, at a\n\nminimum:\n\n1. A description of the design of the system;\n\n2. The identification of the source of water for the system;\n\n3. A description of the manner of storage, distribution and\n. The Department\n\nmay deny any application that fails to establish that the water\n\nsupply meets and can continue to meet the drinking water standards.\n\nIn order to be considered complete, applications shall include, at a\n\nminimum:\n\n1. A description of the design of the system;\n\n2. The identification of the source of water for the system;\n\n3. A description of the manner of storage, distribution and\n\npurification of the water prior to delivery to consumers;\n\n4. A description of the additional testing and source water\n\nprotection measures the system will implement to assure continued\n\ncompliance with drinking water standards; and\n\n5. Any other data and information requested by the Department.\n\nE. Permits issued under subsection D of this section:\n\n1. Shall be classified as Tier 1 permits pursuant to the\n\nOklahoma Uniform Environmental Permitting Act;\n\n2. Shall be subject to additional monitoring requirements when\n\ndetermined necessary by the Department; and\n\n3.
