Stat. tit. 27A, § 27A-2-6-501","heading":"Activities requiring water quality permit - Facility","body":"changes, discharge of sewage - Rules.\n\nA. It shall be unlawful for any person to carry on any of the\n\nfollowing activities with regard to wastewater or sludge without\n\nfirst securing a water quality permit from the Department of\n\nEnvironmental Quality unless such activity is approved in a permit\n\nissued by the Executive Director under Part 2, Article VI, Chapter 2\n\nof this Code:\n\n1. The construction, installation, operation and closure of any\n\nindustrial surface impoundment, industrial septic tank or treatment\n\nsystem, or the use of any existing unpermitted surface impoundment,\n\nseptic tank or treatment system that is within the jurisdiction of\n\nthe Department and which is proposed to be used for the containment\n\nor treatment of industrial wastewater or sludge;\n\n2. The construction, installation or operation of any\n\nindustrial or commercial facility subject to the permitting\n\nauthority of the Department, the operation of which would cause an\n\nincrease in the discharge of waste into the waters of the state or\n\nwould otherwise alter the physical, chemical or biological\n\nproperties of any waters of the state in any manner not already\n\nlawfully authorized;\n\n3. The construction or use of any new outfall for the discharge\n\nof any waste or pollutants into the waters of the state; or\n\n4. The land application of any nonindustrial or industrial\n\nwastewater and the land application of sludge.\n\nB. Any major addition, extension, operational change or other\n\nchange proposed for a facility permitted pursuant to subsection A of\n\nthis section shall require the approval of the Department through\n\nthe major modification of the facility's permit prior to\n\nconstruction or implementation of such addition, extension or\n\nchange.\n\nC. A permit for activities specified in paragraph A of this\n\nsection shall be issued by the Executive Director for no more than\n\nfive (5) years and may be renewed pursuant to rules of the\n\nEnvironmental Quality Board.\n\nD. The discharge of domestic sewage except to a public or\n\nprivate disposal system approved or authorized by the Department or\n\nthe surfacing of effluent from any domestic septic system shall be\n\ndeemed pollution for purposes of the provisions of Section 2-6-105\n\nof this title.\n\nE. The Board may promulgate rules for the implementation of\n\nthis part, including but not limited to the submission of\n\napplications, plans, specifications and other necessary information,\n\nand requirements for monitoring, reporting, operation and\n\nmaintenance, corrective action, construction and closure. Such\n\nrules may incorporate by reference any applicable federal\n\nregulations.\n\nF. Except for closure standards, industrial wastewater system\n\nrules of the Department of Environmental Quality shall not apply to\n\nfacilities governed by the Oklahoma Funeral Board.\n\n1. Such facilities shall:\n\na. report to the Department of Environmental Quality any\n\nspill, leak or other release of industrial wastewater\n\nfrom the facility by telephone within twenty-four (24)\n\nhours of the spill, leak or release in writing within\n\nseven (7) days of the spill, leak or release,\n\nb. take immediate action to contain and remediate the\n\nspill, leak or release to prevent risk to human health\n\nor the environment, including surface water or\n\ngroundwater, and\n\nc. notify adjacent landowners of the spill, leak or\n\nrelease as soon as reasonably possible;\n\n2. Nothing in this subsection shall be construed to relieve\n\nsuch facilities from any requirements of federal law; and\n\n3.
