The Department shall not approve any sludge management\n\nplan or issue any permit for the land application of sludge which\n\ncontains heavy metal concentrations significantly above\n\nconcentration ranges normal to sludges with demonstrated\n\neffectiveness on Oklahoma soils as determined by the Department.\n\nRules promulgated by the Board for applications for sludge\n\nmanagement plans and permits shall require a study of the effects of\n\nthe sludge on the various types of soils and crops found at the\n\nlocation of the proposed sludge application site. Such study shall\n\nencompass the effects of the sludge on the soils and crops during\n\nfour (4) growing seasons.\n\n2. Any municipality having a sludge management plan approved\n\nprior to May 25, 1992, for the land application of sludge containing\n\nheavy metal concentrations significantly above acceptable\n\nconcentration ranges may discontinue such land application of the\n\nsludge or shall develop a corrective action plan containing a\n\nschedule of compliance for reducing the heavy metal concentration to\n\nan acceptable range. The municipality shall submit the corrective\n\naction plan to the Department for approval. If the Department\n\ndisapproves of the plan or the municipality fails to comply with the\n\nplan so approved, the Department may require that any such land\n\napplications of sludge by the municipality be discontinued pursuant\n\nto Article II of the Administrative Procedures Act.\n\nB. For developing statewide criteria for application of sludge\n\nwhich contains heavy metal concentrations significantly above\n\nconcentration ranges normal to sludge, the Department shall utilize\n\na comprehensive study of the potential adverse effects of such\n\nsludge on the soils of this state completed by a qualified research\n\ninstitute familiar with the crops and soils of this state. Such\n\nstudy shall be completed by September 1, 1996, and a report of the\n\nfindings shall be delivered to the Governor, the President Pro\n\nTempore of the Senate, the Speaker of the House of Representatives\n\nand the Executive Director no later than September 1, 1996.","path":["OK Code","Title 27A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os27A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"fd432f72731e0c9d7ab24236f07f43ac21b68dea6651e70db70136a91ba9424d","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-27a-27a-2-6-501.3","next":"us-ok/okla.-stat.-tit.-27a-27a-2-6-501.5"},"notice":"GroundRules: Original legal text.
