Stat. tit. 27A, § 27A-2-7-113.1","heading":"Issuance of permits - Suitability of facility -","body":"Administrative procedures.\n\nA. The Department of Environmental Quality shall issue permits\n\nfor hazardous waste facilities. A permit shall be issued only upon\n\nproper application and determination by the Department that the\n\nproposed site and facility are physically and technically suitable.\n\nB. Upon a finding that a proposed hazardous waste facility is\n\nnot physically or technically suitable, the Department shall deny\n\nthe permit.\n\nC. In accordance with the provisions of Section 2-14-304 of\n\nthis title, an administrative permit hearing shall be available on a\n\nproposed permit which is based on a Tier III hazardous waste permit\n\napplication for a new permit or for the modification of an existing\n\npermit involving a fifty percent (50%) or more increase in permitted\n\ncapacity for storage, treatment or disposal including but not\n\nlimited to incineration.\n\nD. The Department may, upon determining that public health or\n\nsafety requires emergency action, issue a temporary permit for\n\ntreatment or storage of hazardous waste or recyclable material for a\n\nperiod not to exceed ninety (90) days without the prior notices and\n\nopportunity to request a public meeting or the administrative permit\n\nhearing required by this section or the Oklahoma Uniform\n\nEnvironmental Permitting Act.
