Except as provided in subsections B and C of this section,\n\nno permit shall be issued for the off-site disposal of hazardous\n\nwaste or for the off-site treatment of hazardous waste by\n\nincinerator at a new hazardous waste facility proposed to be located\n\nwithin eight (8) miles of the corporate limits of an incorporated\n\ncity or town. For the purposes of this section the corporate limits\n\nof an incorporated city or town shall be the corporate limits in\n\neffect on January 1 of the year the application is filed, and a new\n\nhazardous waste facility means a hazardous waste facility that was\n\nnot in operation and actively treating hazardous waste by\n\nincineration or disposing of hazardous waste during the year\n\npreceding August 30, 1991. Addition of new treatment, storage or\n\ndisposal units to an existing hazardous waste facility does not\n\nconstitute a new facility.\n\nB. This section shall not apply to any facility accepting\n\nhazardous waste exclusively for the purpose of conducting treatment\n\nresearch and design tests.\n\nC.
