Two or more persons generating hazardous waste may enter\n\ninto a compact to construct and operate a multi-user on-site\n\ntreatment facility for the exclusive use of the members of such\n\ncompact. Such facility shall not be used as a hazardous waste\n\nfacility for off-site treatment, storage or disposal of hazardous\n\nwaste.\n\nB. To be eligible for a permit issued pursuant to the\n\nprovisions of this section and the Oklahoma Hazardous Waste\n\nManagement Act, a multi-user on-site treatment facility shall meet\n\nthe following criteria:\n\n1. The facility may be co-owned by the generators of hazardous\n\nwaste who are members of the compact;\n\n2. Each member of the compact shall be identified in the\n\napplication and permit. In addition, the individual hazardous waste\n\ngenerated by each member shall be separately and distinctly\n\ncharacterized in the application and in the permit and shall meet\n\nthe compatibility requirements established by the Department;\n\n3. The facilities generating hazardous waste which is to be\n\ntreated at the multi-user on-site treatment facility shall be\n\nlocated within the same county as the multi-user on-site treatment\n\nfacility;\n\n4. The multi-user on-site treatment facility shall be located\n\nupon the property of one of the compact members;\n\n5. Financial responsibility requirements shall be the\n\nresponsibility of the compact members and shall be prorated\n\naccording to the relative amount of hazardous waste of a generator\n\nto be treated at the facility; and\n\n6. The Department may require such other criteria and\n\ninformation in order to determine if the multi-user on-site\n\ntreatment facility is physically and technically suitable for the\n\nhazardous waste to be treated at the facility.\n\nC. A multi-user on-site treatment facility, located within an\n\nindustrial park which treats, stores or disposes of wastes that are\n\nproduced only within that industrial park, may be owned or operated\n\nby persons other than the generators of the waste.\n\nD. Upon compliance with the provisions of the Oklahoma\n\nHazardous Waste Management Act, this section and rules promulgated\n\nthereunder, the Department shall issue a permit for the construction\n\nand operation of a multi-user on-site treatment facility.\n\nE. The board of county commissioners of the county in which a\n\nmulti-user on-site treatment facility is proposed to be located\n\nshall review all transportation routes between such proposed\n\nlocation and the facilities generating hazardous waste which are\n\noperated by members of the compact.
