The Department of Environmental Quality may direct a\n\nfacility to waive the fees described in paragraph 1 of subsection A\n\nof Section 2-7-121 of Title 27A of the Oklahoma Statutes for\n\nhazardous waste received from certain sites undergoing response\n\nactions under the authority of the federal Comprehensive\n\nEnvironmental Response, Compensation and Liability Act. A fee\n\nwaiver may only be granted for response actions financed through the\n\nSuperfund Trust Fund that are conducted by the Department or the\n\nfederal Environmental Protection Agency, when the amount of fee\n\nwaiver will qualify towards the contributions required of the state\n\nfor such actions.\n\nB. The Department of Environmental Quality may direct a\n\nfacility to waive the fees described in paragraph 1 of subsection A\n\nof Section 2-7-121 of Title 27A of the Oklahoma Statutes for\n\nhazardous waste received from certain sites in Oklahoma undergoing\n\nremedial actions that are being conducted as a result of:\n\n1. A consent order approved by the Department;\n\n2. Fulfilling the requirements of a Compliance Schedule issued\n\nby the Department as a result of a permit; or\n\n3. A Brownfields action that has been approved by the\n\nDepartment.\n\nSuch fee waivers may be granted for remedial actions only when\n\nthe amount of the fee waiver will qualify toward the contributions\n\nrequired of the state in response actions financed through the\n\nSuperfund Trust Fund.
