In accordance with standards established by the\n\nAdministrator of the Environmental Protection Agency pursuant to the\n\nfederal Resource Conservation and Recovery Act, the Department may\n\nrequire corrective action beyond a hazardous waste facility boundary\n\nas a condition of the issuance of a permit pursuant to the Oklahoma\n\nHazardous Waste Management Act, where necessary to protect human\n\nhealth and the environment, unless the owner or operator of the\n\nfacility demonstrates that despite the owner's or operator's best\n\nefforts such owner or operator is unable to obtain the necessary\n\npermission to undertake such action. The Department may also\n\nrequire, as a condition of a permit issued pursuant to the Oklahoma\n\nHazardous Waste Management Act, corrective action for all releases\n\nof hazardous waste from any solid waste management unit at a\n\nfacility seeking a permit, regardless of the time the waste was\n\nplaced in such unit. If such corrective action cannot be completed\n\nprior to issuance of the permit, such permit shall contain schedules\n\nof compliance for the corrective action required and assurances of\n\nfinancial responsibility for completing such corrective action.\n\nB. The Department shall review each permit for a hazardous\n\nwaste land disposal facility five (5) years after the date of such\n\nissuance or reissuance and shall modify the permit as necessary to\n\nassure that the facility continues to comply with the currently\n\napplicable standards and permit requirements for hazardous waste\n\nfacilities. Nothing in this subsection shall preclude the\n\nDepartment from reviewing and modifying a permit at any time during\n\nits term. The Department, in reviewing any application for a permit\n\nrenewal, shall consider improvements in the state of control and\n\nmeasurement technology and changes in applicable regulations. Each\n\nissued or reissued permit shall contain such terms and conditions as\n\nthe Department determines necessary to protect human health and the\n\nenvironment.\n\nC. The Department is authorized to require each owner or\n\noperator applying for a permit for a hazardous waste landfill or\n\nsurface impoundment to submit with the permit application\n\ninformation reasonably ascertainable by the owner or operator\n\nconcerning the potential exposure to the public of hazardous wastes\n\nas a result of releases from a hazardous waste unit.
