There is hereby created in the State Treasury a special fund\n\nfor the Department to be designated as the \"Hazardous Waste Fund\".\n\nThis fund shall consist of monies transferred to it from funds\n\nappropriated to the Department for this purpose and from other\n\nsources as provided by law. The fund shall be a continuing fund not\n\nsubject to fiscal year limitations. Expenditures from the Hazardous\n\nWaste Fund shall be made upon warrants issued by the State Treasurer\n\nagainst claims submitted to the Director of the Office of Management\n\nand Enterprise Services for approval and payment. The fund shall be\n\nfor the purpose of protecting public health and safety as prescribed\n\nin the Hazardous Waste Management Act and for providing basic\n\nemergency response training and protective equipment and for\n\nresponse or remediation activities authorized in subsection F of\n\nSection 2-7-121 of this title. The Department is authorized, upon\n\nthe request of a municipality or county, to assist such municipality\n\nor county in the development of emergency response plans. The fund\n\nshall be under the control and management of the administrative\n\nauthority of the Department. Pursuant to the provisions of the\n\nHazardous Waste Fund Act, the Department is authorized to determine\n\nthe manner in which such fund is to be used. The Department of\n\nPublic Safety and the Department of Civil Emergency Management are\n\nauthorized and directed to assist and cooperate with the Department\n\nin the performance of its duties under the Hazardous Waste Fund Act.\n\nB.
