To be licensed pursuant to this act, a person, firm,\n\ncorporation or other entity shall meet the following requirements:\n\n1. Principal business facilities are located within Oklahoma;\n\n2. Tow trucks are registered and licensed in Oklahoma; and\n\n3. Owner is a resident of the State of Oklahoma or the service\n\nis an Oklahoma corporation.\n\nB. No operator or employee of any operator shall be permitted,\n\nallowed or caused to solicit business or engage in highway\n\nremediation and cleanup services without the operator first having\n\nobtained from the Department of Environmental Quality a license to\n\noperate a highway remediation and cleanup service. The license\n\nnumber shall be displayed, in conformance with rules of the\n\nDepartment, on both sides of every vehicle operated by the highway\n\nremediation and cleanup service. This section shall not apply to\n\nthe Oklahoma Department of Transportation or the Oklahoma Turnpike\n\nAuthority.\n\nC. The license fee required by this section shall be in lieu of\n\nthe motor carrier filing fee as required in Section 165 of Title 47\n\nof the Oklahoma Statutes. It shall not be necessary for any\n\noperator to prove public convenience and necessity to obtain such\n\nlicense, and the Department shall issue such license without public\n\nhearing. The fee for such license shall be Ten Thousand Dollars\n\n($10,000.00).\n\nD. All licenses shall expire on the last day of the calendar\n\nyear and may be renewed annually at a cost of One Thousand Dollars\n\n($1,000.00) upon application to the Department as prescribed by\n\nrule. No license fee shall be refunded in the event that the\n\nlicense is suspended or revoked.\n\nE. The Department is authorized to issue notices of violation\n\nand compliance orders and to suspend, revoke, or refuse to issue or\n\nrenew the license of an operator when it finds the licensee or\n\napplicant has not complied with or has violated any of the\n\nprovisions of this act, or any rules adopted by the Board. A\n\nsuspension shall be for a period of time deemed appropriate by the\n\nDepartment for the violation. An operator whose license has been\n\nrevoked may not apply for one (1) year. Any suspended or revoked\n\nlicense shall be returned to the Department by the operator. An\n\noperator whose license is revoked by the Department shall be\n\nrequired to pay an additional fee of Ten Thousand Dollars\n\n($10,000.00) for reinstatement if such reinstatement is authorized\n\nby the Department.\n\nF. The Department shall keep a current list of highway\n\nremediation and cleanup service operators licensed pursuant to this\n\nact and forward such list to the Department of Public Safety for\n\ndistribution to wrecker service operators licensed by the Department\n\nof Public Safety. The Department shall update such list regularly\n\nto delete highway remediation and cleanup service operators whose\n\nlicenses have been suspended or revoked.\n\nG.
