Stat. tit. 27A, § 27A-2-9-103","heading":"Official agency for regulatory activities -","body":"Application of act - Agreements with United States Nuclear\n\nRegulatory Commission.\n\nA. The Department of Environmental Quality is hereby designated\n\nas the official agency of the State of Oklahoma for all regulatory\n\nactivities for the use of atomic energy and sources of radiation,\n\nexcept for the use of sources of radiation by diagnostic x-ray\n\nfacilities, and shall act as the coordinating agency for the purpose\n\nof cooperating with other states, the United States Public Health\n\nService, and the United States Nuclear Regulatory Commission, and\n\nother federal agencies in the administration of programs relating to\n\natomic energy and sources of radiation, available to the State of\n\nOklahoma under federal laws; and it shall encourage, participate in,\n\nand conduct investigations, training and demonstrations relating to\n\nconstructive uses of radiation and the prevention and control of its\n\nassociated harmful effects, the control of radiation hazards, the\n\nmeasurement of radiation, the effects to health on exposure to\n\nradiation, and related problems.\n\nB. Nothing in this article shall interfere with the doctor-\n\npatient relationship of any practitioner of the healing arts; nor\n\nshall anything in this act prohibit a licensed practitioner of the\n\nhealing arts, or an individual under the direction of such licensed\n\npractitioner, from using X-rays or fluoroscopes for diagnostic\n\npurposes, as authorized under the specific licensing act for the\n\npractitioner and other law.\n\nC. The Governor, on behalf of this state, may enter into\n\nagreements with the United States Nuclear Regulatory Commission,\n\npursuant to Section 274b of the Atomic Energy Act of 1954, as\n\namended, providing for discontinuance of specified responsibilities\n\nof the federal government and for the assumption thereof by this\n\nstate with respect to byproduct material, special nuclear material,\n\nand sources of radiation.\n\nD. Any person who, on the effective date of an agreement under\n\nsubsection C of this section, possesses a license which is subject\n\nto that agreement and which is issued by the United States Nuclear\n\nRegulatory Commission for radioactive materials, shall be deemed to\n\npossess a like license issued under the Radiation Management Act.\n\nSuch license shall expire on the date of expiration specified in the\n\nfederal Nuclear Regulatory Commission license.","path":["OK Code","Title 27A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os27A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"59c3f2b69cb3788c27c2c92b7f294fb34434c87a447b65b46d06e5746e46b74f","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-27a-27a-2-9-102","next":"us-ok/okla.-stat.-tit.-27a-27a-2-9-104"},"notice":"GroundRules: Original legal text.
