Stat. tit. 27A, § 27A-2-9-107","heading":"Exercise of federal authority - Impoundment of","body":"radioactive materials.\n\nThe authority reserved to the United States Nuclear Regulatory\n\nCommission shall only be exercised by this state after this state\n\nhas achieved agreement status with the Commission pursuant to\n\nSection 274b of the Atomic Energy Act of 1954, as amended. In the\n\nevent of an emergency which threatens the public health, safety and\n\nwelfare or the environment, the Department of Environmental Quality\n\nmay impound or order the impounding of by-product material, special\n\nnuclear material, and sources of radiation in the possession of any\n\nperson who is not equipped to observe or fails to observe the\n\nprovisions of the Radiation Management Act or any rules issued\n\nthereunder.
