The Legislature recognizes that historic lead and zinc\n\nmining operations have caused severe environmental degradation in\n\nareas of this state. The Legislature further recognizes that this\n\ndegradation has caused the United States Environmental Protection\n\nAgency to place large areas within the state, including entire\n\nmunicipalities, on its Superfund National Priorities List of the\n\nmost seriously contaminated sites in the nation.\n\nB. The Legislature finds that lead poses a unique threat to\n\nchildren six (6) years of age and younger. During this period of\n\ntheir development children are particularly vulnerable to\n\nneurological damage caused by lead exposure. The effects of this\n\nchildhood exposure can continue throughout their lives.\n\nC. The Legislature hereby finds and determines that, as shown\n\nby studies conducted by the State Department of Health and the\n\nUnited States Indian Health Service, children six (6) years of age\n\nand younger, living in the vicinity of these former mining areas,\n\nexhibit blood lead levels above the thresholds considered dangerous\n\nto human health, and continued exposure of such children to lead\n\nconstitutes a significant danger to the health of such children in\n\nthe future. Further, the Legislature hereby determines a need\n\nexists to remedy the problem, by providing incentives for families\n\nwith children six (6) years of age and younger to relocate outside\n\nthe area of contamination.\n\nD. The Legislature further recognizes that much of the damage\n\ncaused by historic lead and zinc mining has resulted in a serious\n\nsubsidence risk in the affected areas. The United States Army Corps\n\nof Engineers has identified municipalities within those areas where\n\nthe risk of subsidence poses an imminent risk to the public and the\n\nLegislature therefore finds that a need exists to remedy this\n\nproblem by expanding the purpose of this act to provide incentives\n\nfor those owning or leasing property in the affected areas to\n\nrelocate to areas of greater safety.","path":["OK Code","Title 27A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os27A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"bf7ecb127f66aad2ce62d549f9d99b02990d395c970cb6f0ca1b150dc1d9ff9a","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-27a-27a-2201","next":"us-ok/okla.-stat.-tit.-27a-27a-2203"},"notice":"GroundRules: Original legal text.
