Stat. tit. 27A, § 27A-3-1-103","heading":"Definitions","body":"As used in the Conservation District Act:\n\n1. \"District\" or \"conservation district\" means a governmental\n\nsubdivision of this state, and a public body corporate and politic,\n\norganized in accordance with the provisions of the Conservation\n\nDistrict Act, for the purposes, with the powers, and subject to the\n\nrestrictions hereinafter set forth;\n\n2. \"Director\" means a member of the governing body of a\n\nconservation district, elected or appointed in accordance with the\n\nprovisions of the Conservation District Act;\n\n3. \"Commission\" means the Oklahoma Conservation Commission;\n\n4. \"State\" means the State of Oklahoma;\n\n5. \"Agency of this state\" includes the government of this state\n\nand any subdivision, agency or instrumentality, corporate or\n\notherwise, of the government of this state;\n\n6. \"United States\" or \"agencies of the United States\" includes\n\nthe United States of America, and any department, agency or\n\ninstrumentality of the federal government;\n\n7. \"Government\" or \"governmental\" includes the government of\n\nthis state, the government of the United States, and any\n\nsubdivision, agency or instrumentality, corporate or otherwise, of\n\neither of them;\n\n8. \"Due notice\" which shall be in conformance with the\n\nAdministrative Procedures Act means notice published at least twice,\n\nwith an interval of at least seven (7) days between the two\n\npublication dates, in a newspaper or other publication of general\n\ncirculation within the district, or, if no such publication of\n\ngeneral circulation is available, by posting at five conspicuous\n\nplaces within the district, such posting to include, where possible,\n\nposting at public places where it may be customary to post notices\n\nconcerning county or municipal affairs generally. At any hearing\n\nheld pursuant to such notice, at the time and place designated in\n\nsuch notice, adjournment may be made from time to time without the\n\nnecessity of renewing such notice for such adjourned dates;\n\n9. \"District cooperator\" means any person that has entered into\n\na cooperative agreement with a conservation district for the purpose\n\nof protecting, conserving and practicing wise use of the renewable\n\nnatural resources under his or her control;\n\n10. \"Renewable natural resources\", \"natural resources\" or\n\n\"resources\" include land, soil, water, vegetation, trees, natural\n\nbeauty, scenery and open space;\n\n11. \"Conservation\" includes conservation, development,\n\nimprovement, maintenance, preservation, protection and wise use of\n\nland, water and related natural resources; the control and\n\nprevention of floodwater and sediment damages; and the disposal of\n\nexcess surface waters;\n\n12. \"Cost-Share program\" means the assumption by the state of a\n\nproportional share of the cost of installing conservation\n\nstructures, conservation practices or best management practices on\n\nlands for public and environmental benefits;\n\n13. \"Best management practices\" means a control method or\n\ncombination of control methods that is determined to be the most\n\neffective and practicable means of preventing soil loss from erosion\n\nor reducing the amount of nonpoint source pollution from a given\n\nland use;\n\n14. \"Nonpoint source\" shall have the same meaning as such word\n\nis defined by the Oklahoma Environmental Quality Act;\n\n15. \"Pollution\" shall have the same meaning as such word is\n\ndefined by the Oklahoma Environmental Quality Act;\n\n16. \"Nonpoint source working group\" means an advisory group\n\nestablished by the Conservation Commission to provide input into the\n\nstate's nonpoint source management and assessment program and is\n\nopen to federal, state and local environmental agencies and natural\n\nresource agencies and other interested groups;\n\n17. \"Watershed\" means an area of land that drains to a given\n\npoint;\n\n18. \"Blue Thumb Program\" means a nonpoint source educational\n\nprogram emphasizing water quality education, including volunteer\n\nmonitoring;\nto the\n\nstate's nonpoint source management and assessment program and is\n\nopen to federal, state and local environmental agencies and natural\n\nresource agencies and other interested groups;\n\n17. \"Watershed\" means an area of land that drains to a given\n\npoint;\n\n18. \"Blue Thumb Program\" means a nonpoint source educational\n\nprogram emphasizing water quality education, including volunteer\n\nmonitoring;\n\n19. \"Soil science\" means the science which:\n\na. is the study of physical, chemical, and biological\n\nprocesses taking place in both naturally occurring and\n\nreconstructed unconsolidated material formed by the\n\nalteration of parent rock due to exposure at the\n\nearth's surface, and\n\nb. includes sampling, measuring, identification,\n\ncharacterization, classification, and mapping of soil\n\nmaterials and migration of water solute, air and other\n\ngaseous components in the unsaturated portion of the\n\nearth; and\n\n20. \"Soil scientist\" means a person who:\n\na. has earned a baccalaureate or higher degree in a field\n\nof soil science from an institution of higher\n\neducation which is accredited by a regional or\n\nnational accrediting agency, with a minimum of thirty\n\n(30) semester hours or forty-five (45) quarter hours\n\nof undergraduate work in a field of biological,\n\nphysical, or earth science with a minimum of fifteen\n\n(15) semester hours of core soil science courses, and\n\nb. has a specific and continuous record of related and\n\nverifiable soil science work experience for two (2)\n\nyears.
