Stat. tit. 27A, § 27A-3-4-106.1","heading":"Oklahoma State Facilities Energy Conservation","body":"Program.\n\nA. There is hereby created the Oklahoma State Facilities Energy\n\nConservation Program.\n\nB. As used in this section:\n\n1. \"State agency\" means any office, officer, bureau, board,\n\ncommission, counsel, unit, division, body, authority or institution\n\nof the executive branch of state government, whether elected or\n\nappointed and shall include institutions within The Oklahoma State\n\nSystem of Higher Education. Technology Center School Districts\n\nshall not be subject to the provisions of this act but are\n\nencouraged to implement local district energy conservation efforts\n\nas approved by the local technology center board;\n\n2. \"State facilities\" or \"facilities\" means buildings or assets\n\nowned or operated by a state agency which have a heating,\n\nventilation, or air conditioning system or utility services;\n\n3. \"Program\" means the Oklahoma State Facilities Energy\n\nConservation Program;\n\n4. \"Director\" means the Director of the Office of State\n\nFinance; and\n\n5. \"IPMVP\" means the International Performance Measurement and\n\nVerification Protocol.\n\nC. All state facilities shall be subject to the provisions of\n\nthe Oklahoma State Facilities Energy Conservation Program. The\n\nDirector of the Office of State Finance, or a designee selected by\n\nthe Director, shall oversee the development and implementation of\n\nthe Program, including the selection of the most qualified vendor or\n\nvendors by utilizing a request for proposal to contract for the\n\ndevelopment and implementation of an organizational behavior-based\n\nor performance-based energy conservation program.\n\nD. The objectives and scope of the Program and the request for\n\nproposal shall be to:\n\n1. Promote a centralized effort to gather information\n\npertaining to energy use in state facilities and designate\n\nknowledgeable personnel to prioritize projects and make\n\nrecommendations for conservation implementation;\n\n2. Benchmark state facilities energy usage prior to\n\nimplementation of the Program and measure energy conservation\n\nsavings utilizing commercially available energy accounting software\n\nthat adheres to the IPMVP;\n\n3. Target a cumulative energy savings of not less than twenty\n\npercent (20%) by the year 2020 when compared to the 2012 fiscal year\n\nutility expenditures. The express purpose of the targeted energy\n\nsavings shall be to capitalize on opportunities for organizational\n\nbehavior-based or performance-based energy conservation efforts and\n\nexisting equipment and building optimization while maintaining or\n\nimproving the operational environment during times when facilities\n\nare occupied;\n\n4. When reasonably feasible, consider working with local\n\nutilities in implementing energy reduction efforts and to utilize\n\nutility demand side management and energy efficiency programs to\n\nfurther capture energy efficiency potential;\n\n5. Provide an annual reconciliation of the costs versus the\n\nsavings resulting from the Program as determined by the Director\n\nutilizing the selected energy accounting software;\n\n6. Fully fund the Program within existing state agency budgets\n\nthrough savings generated by reducing energy costs;\n\n7. Endeavor to utilize, when reasonably possible, existing\n\npersonnel to implement the Program at state facilities, provided\n\nthat compensation costs for additional personnel or additional\n\ncompensation costs for existing personnel dedicated exclusively to\n\nimplementation of the Program shall be funded from the savings\n\ngenerated by the Program;\n\n8. Include implementation of a formalized organizational\n\nbehavior-based or performance-based energy conservation program;\n\n9. Evaluate existing facility energy accounting systems and\n\ndetermine if the existing systems or a commercially available energy\n\naccounting software program will be utilized to measure savings from\n\nthe Program in a way that adheres to the IPMVP;\ngenerated by the Program;\n\n8. Include implementation of a formalized organizational\n\nbehavior-based or performance-based energy conservation program;\n\n9. Evaluate existing facility energy accounting systems and\n\ndetermine if the existing systems or a commercially available energy\n\naccounting software program will be utilized to measure savings from\n\nthe Program in a way that adheres to the IPMVP;\n\n10. Seek to obtain ENERGY STAR recognition for facilities that\n\ncomply with the necessary requirements as established by the United\n\nStates Environmental Protection Agency;\n\n11. Provide for an initial fee-free period of not less than\n\ntwelve (12) months during which foundational elements of the Program\n\nare established and energy savings are generated before any fee\n\npayments are due to a selected vendor; and\n\n12. Provide for free ongoing support from the vendor beyond the\n\ninitial term of the Program, if the state substantially continues\n\nimplementation of the Program.\n\nE. Upon implementation of the Program, all state agencies shall\n\ninput historical utility cost data into an IPMVP-adherent energy\n\naccounting software database on a monthly basis and shall deliver an\n\nannual report on the progress and cost savings of the Program to the\n\nDirector within ninety (90) days after the end of each fiscal year.\n\nF. Upon notification by a state agency, the Director shall\n\nconsider any organizational behavior-based or performance-based\n\nenergy conservation programs under contract with a state agency\n\nprior to August 24, 2012, to be in compliance with the provisions of\n\nthis section.\n\nG. Compliance with the Program shall not prohibit any state\n\nagency from entering into a performance-based efficiency contract\n\nfor capital improvements pursuant to Section 318 of Title 62 of the\n\nOklahoma Statutes. The Director is authorized to work with state\n\nagencies to develop a separate statewide plan for capital\n\nimprovements for performance-based efficiency contracts pursuant to\n\nthe provisions of Section 318 of Title 62 of the Oklahoma Statutes.","path":["OK Code","Title 27A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os27A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"bba6a86e7d2e94baca1b7bd5786e7652fc4bf236f509bd992ce8e2935c37269e","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-27a-27a-3-4-105","next":"us-ok/okla.-stat.-tit.-27a-27a-3-5-101"},"notice":"GroundRules: Original legal text.
